The purpose of this chapter is to establish all-terrain vehicle routes in the Village and to regulate the operation of all-terrain vehicles and utility-terrain vehicles within the Village limits. The Village has specific authority to designate routes and adopt restrictions on periods of use pursuant to § 23.33(8), Wis. Stats..
The statutory provisions in Chapters 23.33 and 340 to 348, Wis. Stats., establishing definitions and regulations with respect to ATVs and UTVs, and Ch. NR 64, Wis. Adm. Code are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Unless otherwise provided in this chapter, any act required to be performed or prohibited by any statute or regulation incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions, or modifications of the statutes or regulations herein are made a part of this chapter in order to secure uniform statewide regulation of ATVs and UTVs. Any terms used in this chapter that are defined in § 23.33(1), Wis. Stats., shall have the meaning proscribed by statute.
A. 
All Village-maintained streets within the jurisdiction of the Village of Sauk City are authorized as all -terrain vehicle routes except as may be posted.
B. 
Pursuant to § 23.33(11)(am) 4., Wis. Stats., State highways 60 & 78 from the north Village limits to U.S. Highway 12/Phillips Blvd. within the territorial boundaries of the Village where the speed limit is 35 miles per hour or less is authorized as an all-terrain vehicle route.
C. 
U.S. Highway 12 is not authorized as a UTV/ATV route.
The Village Public Works Department shall place signs as required by law to designate all Village streets as all-terrain vehicle routes. Route signs shall be provided by the Honey Creek ATV/UTV Club, LLC, or their successor, with uniform all-terrain vehicle route signs in accordance with Ch. NR, 64.12(7), Wis. Adm. Code.
A. 
In addition to the state laws adopted herein by reference, the following restrictions and rules shall apply to operation of and riding on ATVs and UTVs within the limits of the Village of Sauk City:
(1) 
The operation of ATVs and UTVs is restricted to the daily period of one-half hour before sunrise to one-half hour after sunset the same day.
(2) 
Operators shall observe the posted roadway speed limits and all other applicable traffic regulations.
(3) 
Operators shall always ride in a single file.
(4) 
ATV/UTV headlamps and taillamps must be turned on at all times and must have operational brake lights. ATV/UTVs also must confirm to the § 23.33, Wis.Stats., regarding the color of headlamps and taillamps. Auxiliary light bars must be turned off at all times.
(5) 
UTV operators and passengers must wear seat belts at all times, and if under the age of 18, operators and passengers must also wear a minimum DOT standard ATV or motorcycle helmet with the chin strap properly fastened as required by § 23.33, Wis. Stats.
(6) 
ATV operators and passengers under the age of 18 must wear a minimum DOT standard ATV or motorcycle helmet with the chin strap properly fastened as required by § 23.33, Wis. Stats.
(7) 
ATV/UTV operators cannot have a passenger riding in or on any part of ATV/UTV that is not designed and not intended for use by passengers. After market seating does not comply with the law. It must be manufactured as a multiple passenger machine to be legal for passengers.
(8) 
ATV/UTV operators shall possess a valid operator's license as defined in § 340.01(41g), Wis. Stats., as may be amended.
(9) 
Operators of ATV/UTVs must possess proof of current liability insurance on the ATV/UTV and show such proof if requested by law enforcement.
(10) 
ATV/UTV operators born after January 1, 1988, must have a valid safety certificate and present that certificate if requested by law enforcement.
(11) 
It shall be unlawful for any person to operate an ATV or UTV in such a manner as to cause, or disturb the peace, by excessive and unnecessary acceleration, the tires of such vehicle to spin or emit loud noises, to unnecessarily throw stones or gravel, or to cause the wheels to leave the ground.
(12) 
ATV/UTVs must have a current registration, which will include a rear license plate.
(13) 
No person may operate an ATV/UTV upon any sidewalk or pedestrian way.
Violations shall incur the maximum penalties set forth in § 23.33(13), Wis. Stats., as amended. This chapter may be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.
If any provision of this chapter or its application to any person or circumstance is held to be invalid or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions shall not be affected and shall be valid and enforceable to the fullest extent permitted by law.
The designation for the all-terrain vehicles routes herein shall be effective for a trial period until August 31, 2023, whereupon the Village's designation of the all-terrain vehicles routes shall expire unless the Village Board passes an ordinance eliminating this sunset clause.
