A Village-wide uniform numbering system of all buildings and the prominent easily read display of the individual property and street address numbers will assist emergency personnel in responding efficiently and quickly to an emergency. It is, therefore, in the best interest of the public health, safety and welfare of the Village of Briarcliff Manor to enact this chapter.
As used in this chapter, the following term(s) shall have the meanings indicted:
BUILDING
The principal building or buildings on each lot and, unless otherwise determined by the Building Inspector, shall not include any accessory building on a single-family residential lot. For the purposes of this chapter, any separately partitioned unit of a multifamily residence, multitenant commercial building, or other multiunit structure with separate entrances shall each be considered a building.
CODE ENFORCEMENT OFFICER
The Briarcliff Manor Building Inspector, Assistant Building Inspector, their designees or Chiefs of the Briarcliff Manor Fire Department, or other authorized Village employees.
IDENTIFYING NUMBER
A unique number designating a particular building located on the street of the lawfully assigned property address.
STREET
Any street, road, parkway, or public right-of-way used by vehicular traffic.
It shall be the duty of every owner, occupant, or tenant of any building in the Village of Briarcliff Manor to cause to be displayed and maintained an identifying number representing the street address of each building as per the contents of this chapter. Identifying numbers shall be constructed of durable material and shall be maintained in such condition as to be readily visible as required by § 94-6 herein.
On any lot containing more than one building, the Building Inspector, or his designee, shall be authorized to decide which buildings shall be uniquely numbered.
A. 
Size.
(1) 
On all lots containing single-family homes in residential districts, the figures comprising the identifying number are to be at least four inches in height with a minimum width of 0.5 inch (12.7mm).
(2) 
On all lots containing multifamily homes in residential districts, or any buildings in commercial districts, or any building on any lot operating under a special permit, the figures comprising the identifying number are to be at least six inches in height with a minimum width of 0.5 inch (12.7mm).
(3) 
If the building upon which the number is to be displayed is not visible from the street, or is more than 50 feet from the edge of the right-of-way (whether improved or not) of the street serving the building, the number shall be displayed on a mailbox, lamppost, sign, pole, driveway marker or other non-building structure, of at least four feet in height and not exceeding 10 feet in height in a prominent and conspicuous place readily visible from the street and in no event further back than five feet from said street right-of-way. Where numbers are affixed or placed on said non-building structures, such marker must be no more than five feet from the driveway.
B. 
Font. The displayed numbers shall be block Arabic numerals.
C. 
Color. The color of said figures shall be in sharp contrast to the color of the background.
A. 
To the maximum extent practicable, identifying numbers shall be displayed in such a manner as to be plainly legible and visible from the center of the street of address when facing the building at all times between sunrise and sunset.
B. 
To the maximum extent practicable, the numbers shall be placed so that they are seen from either direction while driving on the street or road.
C. 
The numbers shall not be placed on any door of a building, garage, or any other door.
D. 
The numbers shall not be obstructed by trees, shrubbery, porches or other extensions of the building, shoveled or plowed snow, or any other obstruction.
E. 
Lighting. Wherever practicable, the numbers shall be reflective and placed near a light or other source of illumination so that the numbers may be readily seen at night.
On parcels where more than one building accesses the street from a single driveway or roadway, an identifying number or directional signage for each building must be displayed and maintained at each location where the driveway access diverges from the common access to the street.
All multifamily homes, multitenant commercial buildings, and any building on a lot operating under special permit, shall also display and maintain an identifying number upon, above, or to the side of each exterior door facing the rear of such property.
The display of any number other than the identifying number authorized or assigned by the Building Inspector is prohibited.
A. 
New subdivisions. Prior to final approval by the Planning Board, in any subdivision which has one or more private roads or proposed new Village roads, the developer or owner shall propose a name of each such road. The name of all private roads and proposed new Village roads shall be approved by the Village Board prior to Planning Board approval or as a condition of final subdivision approval. The Planning Board and the owner shall notify the Superintendent of the Department of Public Works, the Building Inspector, Fire Department, Ambulance Department, and Briarcliff Manor Police Department, and Westchester County Department of Emergency Services of the new road name and location.
B. 
Existing properties. Any existing private road or driveway which serves three or more buildings, separate parcels and/or building lots shall be considered a private road. Such private roads shall be named according to the policies approved by a resolution of the Board of Trustees.
C. 
Signage. The approved name of a private road and of a proposed new Village road shall be posted by a street sign at each intersection of the road. All signs shall be similar in terms of construction and character to those signs installed by the Village of Briarcliff Manor for public roadways. The private road signs shall state the name of the private road, and shall include, under the name, the words "Private Road" in smaller letters. For private roads existing and not signed at the date of adoption of this chapter, the Superintendent of the Department of Public Works shall purchase and install the signs. In all new subdivisions the signs shall be installed prior to issuance of any building permits and construction of any structures, and the signs shall be paid for and installed by the owner or developer.
A. 
Noncompliance deemed a violation. The failure of any person, corporation, partnership or other entity owning a building within the Village of Briarcliff Manor to comply with the requirements of this chapter within 30 days after initial notice from a Code Enforcement Officer shall be deemed a violation of this chapter.
B. 
Nonmaintenance deemed a violation. The failure of any person, corporation, partnership or other entity owning a building within the Village of Briarcliff Manor to maintain the numbers in accordance with the requirements of this chapter shall be deemed a violation of this chapter.
C. 
Service of notice. A notice of violation may be given by personal service or by certified mailing to the last known address of the owner as shown on the most recent assessment roll on file in the Assessor's office of the Village of Briarcliff Manor.
D. 
Numbering of building and property by Village. In the event of the failure, neglect or refusal of any owner and/or occupant/tenant, after notice, to comply with the requirements of this chapter, the Building Inspector, or his designee, may cause said building and property to be numbered in accordance with the requirements of this chapter to the extent practicable.
E. 
Report; assessment of costs. The Building Inspector shall report the cost of said numbering to the Village Board, and the Village Board shall order said cost to be levied and assessed as a lien against the property of the owner and collected in the same manner as other Village taxes. The remedy provided in these Subsections D and E shall be in addition to, and not in lieu of, the penalties provided in § 94-12 hereunder.
Any person, corporation, partnership or other entity violating any of the provisions of this chapter shall, upon conviction, be guilty of a violation punishable by a fine not to exceed $250. Each calendar week or portion thereof that said violation continues shall be deemed a separate and distinct violation.
This chapter shall be enforced by any Code Enforcement Officer as defined in Chapter 104 or as defined herein.
If any provision of this chapter conflicts with the Property Maintenance Code of New York State, the more restrictive provision shall prevail.
