A. 
As used in this chapter, the following terms, shall have the meanings indicated, unless a different meaning clearly appears from the context:
ANIMAL
Any domestic animal or fowl, or any wild animal or household pet, or any small animal or large animal as defined herein.
DOMESTIC ANIMAL
Any animal normally domesticated or raised in the area and climate as livestock or for work or breeding purposes, normally or ordinarily kept as a household pet.
FOWL
Any wild or domestic animal such as, but not by limitation, animals of the chicken, turkey, goose, duck, pigeon, mallard, quail species.
HOUSEHOLD PET
Any dog, cat, small lizard, turtle, gerbil, fish or other animal normally and ordinarily kept in confined quarters or permitted to be at-large in the dwelling of its owner.
LIVESTOCK
Poultry, cattle, swine, sheep, goats, alpacas/llamas, horses, donkeys, and mules.
OFFICER
Any police officer or state dog warden, state game warden, licensed veterinarian, or code enforcement officer or his or her designee.
PERSON
Any individual, partnership, public or private association or corporation, firm, trust, estate, municipality, government unit, public utility or any other legal entity whatsoever, which is recognized by law as the subject of rights and duties. For purpose of this chapter, the term "owner" as used herein shall have the same meaning as "person" as defined herein.
WILD OR EXOTIC ANIMAL
Any animal, including bird, fowl, reptile, non-human primates (chimpanzees, monkeys, lemurs, etc.), nondomesticated cats/dogs, bears, or insects not normally or ordinarily domesticated, not normally or ordinarily raised in this area and climate as livestock or for work or breeding purposes; or not capable of being kept as a household pet (not intended to be an exhaustive list).
B. 
In this chapter, the singular shall include plural, the plural shall include singular, and the masculine shall include the feminine.
A. 
It shall be unlawful for any person to keep and raise wild or exotic animals at any place within the Borough of Milton.
B. 
Importation of infected animals - no animals mentioned in this chapter suffering from communicable disease or a member of a group of animals subject to quarantine for any reason shall be imported into the Borough of Milton.
A. 
No person who owns, maintains, keeps, or has custody of a dog, cat, or other animal shall fail to use all reasonable precautions to confine or contain such dogs, cats, or other animals to the property of such person or the property which the owner, custodian, or keeper has permission to use for such purposes.
B. 
The keeper or owner of any allowable animals is solely responsible for compliance with all county, state, and federal water quality standards and regulations associated with the keeping of any livestock, fowl, or other animal.
C. 
The remains of any deceased animal may be buried on the owner's parcel provided that the remains are buried at least three feet deep. Burial is also permitted within any cemetery allowing the burial of animal remains, subject to the cemetery owner's approval.
A. 
It shall be unlawful for any person to keep any animals, except household pets, except as provided in this section:
(1) 
Livestock, fowl, and apiaries (bees) may be kept within the Borough of Milton with conditional use approval by Borough Council as permitted in the Zoning Ordinance.
(2) 
Livestock, fowl, and apiaries (bees) shall be confined in quarters no part of which shall be closer than 100 feet from the exterior limits of any dwelling or of any property line - those containing an apiary (bees) shall be well marked.
(3) 
The keeper of every animal shall confine the same in an enclosure sufficient to prevent such animal from running at large, and such enclosure shall be of a size and construction conducive to the animal's health, and adequate sanitary drainage facilities shall be provided.
(4) 
Every keeper of any animal shall cause the litter and droppings there from to be collected daily in a fully enclosed container or receptacle that when closed shall be rat-proof and fly-tight, and after every such collection shall cause such container or receptacle to be kept closed. At least once a week, every such keeper shall cause all litter and droppings so collected to be disposed of in such a manner as to not permit the presence of fly larvae.
(5) 
Every keeper of any animal shall cause all feed provided therefore to be stored and kept in a rat-proof and fly-tight building, box, container, or receptacle.
It shall be unlawful for any person to keep any household pet, except as provided in this section:
A. 
If any pet shall be kept in a dwelling owned or occupied by its owner, such owner shall be required to follow such procedures and practices, as to the number of such pets to be kept there, and as to sanitation, to insure that no public nuisance shall be created or maintained and no threat to the health of persons living elsewhere that in such dwelling shall be created.
