The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
DEPOSITING
Dump, deposit, throw, shovel, push, plow, scoop, shuffle, release, pitch, or other causes of dump or deposit.
MATERIALS
Grass, yard waste, flowers, debris, uprooted trees, branches, leaves, mud, dirt, snow, ice, hail, sleet, and other dangerous articles.
RESPONSIBLE PARTY
Owner, agent, tenant, occupant, person, persons, firm, partnership, corporation, other legal entities, or all other persons or entities having charge or control of any lots, lands, dwellings, buildings and all other premises.
RIGHTS-OF-WAY
Public roadways, streets, gutters, storm drains, catch basins, alleys, highways, rivers, streams, and other Borough rights-of-way.
A. 
It shall be unlawful for any responsible party depositing any materials in the rights-of-way within Charleroi Borough. Each day's violation of this section shall constitute a separate offense.
B. 
It shall be unlawful for any real property owner to allow or permit any depositing of any materials in the rights-of-way within Charleroi Borough. Each day's violation of this section shall constitute a separate offense.
A. 
Any responsible party and any real property owner violating this article shall be guilty of a summary offense, subject to summary prosecution, and shall be fined per violation not less than $250 and not to exceed $1,000.
B. 
Each day the responsible party and real property owner violates this article, it shall be considered a separate occurrence and shall subject the violator(s) to further fines and/or penalties,
C. 
If the fine, or fines and/or penalties are not timely paid, the Magisterial District Judge may prescribe imprisonment not to exceed 30 days.
D. 
Each day the responsible party and real property owner violates this article, it shall be considered a separate occurrence and shall subject the violator(s) to further fines and/or penalties.
E. 
In addition to any penalty imposed for violation of this article, the responsible party and real property owner in default shall be liable for all damages sustained by any person by reason of the neglect or failure of such responsible and real property owner, to comply with the provisions of this article.
In the case of conflict between this article or any part hereof, and the whole or part of any existing ordinance of the Borough, the provision that establishes the higher standard shall prevail.
If any section, subsection, clause, provision, or portion of this article is held to be invalid or unconstitutional by any court of competent jurisdiction, such holding shall not affect any other section, subsection, clause, provision, or portion of this article.
This article shall take effect and be in force five days after its enactment as provided by law.
