The purpose of this article is to protect the integrity of newly paved and constructed roadways within the City of Salem and set forth a time period during which excavation and road opening permits shall not be permitted or issued. This amendment is intended to take into consideration and promote construction in areas where municipal utility extensions, repairs, or replacements have been made as well as in areas where a newly paved roadway surface has been completed.
The limitations outlined herein shall be applicable to all contractors, utilities, and others who may apply for excavation and road opening permits within the City of Salem except in the case of emergency as defined elsewhere within these standards.
A. 
There shall be established a period of 60 months from the date of completion and of any roadway reconstructed and funded through the use of City funds, NJDOT aid or discretionary aid programs.
B. 
Exemptions (with approval of Mayor and Counsel):
(1) 
New home, commercial or industrial construction on a previously vacant parcel of land.
(2) 
In the case of an emergency which would threaten the health, safety, and welfare of the citizens of the City of Salem.
(3) 
In the case of a homeowner changing their home heating service from oil to gas.
A. 
All initial openings shall be saw cut for maximum dimension of two feet by four feet and an additional one foot wide on each side of the initial temporary trench for final restoration purposes. If the roadway cannot accommodate these dimensions, a full lane or full roadway restoration, in the discretion of the municipal engineer, shall be required.
B. 
The trench shall be backfilled with clean fill, free of clay and debris and compacted in twelve-inch lifts to the satisfaction of the engineer unless otherwise stipulated.
The typical subbase, base and surface course restoration should be consistent with the following:
A. 
Dry flowable fill 15:1, eight inches thick.
B. 
Hot-mixed asphalt (HMA) 19.M64, 12M64 or an equivalent base course 2 1/2 inches thick.
C. 
Hot-mixed asphalt (HMA) 9.5M64, 12M64 or an equivalent surface course 2 1/2 inches thick.
D. 
The above-noted restorations will require that asphalt oil be applied to the joint as a waterproof seal abutting the old and new pavement surfaces.
Contractor warranty or guaranty shall apply after permanent pavement restoration has been satisfactorily completed and approved by City Engineer for the balance of the sixty-month period or 24 months, whichever is longer. Should settlement of the restored pavement area occur within the dates, contractor shall be required to mill and/or excavate and repair the area to the satisfaction of the City Engineer and Roadway Supervisor consistent with the provisions of this article or as directed by the Engineer.
