As used in this chapter, the following terms shall have the meanings indicated:
FUEL
Solid, liquid or gaseous combustible materials.
INCINERATOR
Any structure or furnace in which combustion takes place and refuse is used as fuel, along or in conjunction with fossil fuel.
REFUSE
All waste material, including but not limited to garbage, rubbish, incinerator residue, street cleanings, dead animals and offal.
RINGELMANN CHART
The chart published and described in the United States Bureau of Mines Information Circular 7718, or which estimate the light-obscuring density of smoke. The Micro Ringelmann Chart, a photographically reproduced reproduction approximately 1/18 the size of the "Ringelmann Chart" is acceptable as an equivalent standard.
RUBBISH
Solid or liquid waste material, including but not limited to paper and paper products, rags, trees or leaves, needles or branches therefrom, vines, lawn and garden debris, chemicals, paint, grease, sludges, oils and other petroleum products, wood, sawdust, demolition materials, tires and automobiles or automobile parts.
SMOKE
An air contaminant consisting of small gas-borne particles emitted by an air contamination source in sufficient numbers to be observable.
No person shall construct, install, use or cause to be used any incinerator which emits smoke, the shade or appearance of which is equal to or greater than:
A. 
Number 1 on the Ringelmann Chart, or equivalent standard acceptable to the Environmental Conservation Commissioner of the State of New York, for a period of three or more minutes during any continuous sixty-minute period; or
B. 
Number 2 on the Ringelmann Chart, or equivalent standard acceptable to the Environmental Conservation Commissioner of the State of New York, for any time period.
A. 
No incinerator, built or installed after January 26, 1967, regardless of size, shall emit smoke of an opacity denser than 20% or No. 1 of the Ringelmann Chart or equivalent, under normal operating conditions.
B. 
No incinerator built or installed prior to January 26, 1967, regardless of the size, shall be operated so as to emit smoke of an opacity denser than 40% or No. 2 of the Ringelmann Chart or equivalent, under normal operating conditions.
Notwithstanding the provisions of this chapter, no person shall permit the emission of air contaminants in quantities which alone or in combination with emissions from other air contamination sources would contravene any established ambient air quality standard and/or cause air pollution.
It shall be the duty of the Superintendent of Buildings and the Building Inspector of the Village of Ardsley to implement the legislative intentions set forth in this chapter. A violation of this chapter shall be punishable by fine not to exceed $250 or 15 days in jail.
This chapter is not intended and shall not be deemed to impair the powers of any other public corporation or to supersede any application of New York State laws.
