It shall be unlawful for any person to throw, kick or project in any manner whatever in the streets, lanes, alleys or sidewalks of the Town of Selbyville any stone, ball or other missile, including but not limited to the playing or practicing of athletic games, quoits, pitching pennies, playing marbles and like games.
Any person, firm or corporation violating any of the provisions of this article shall be issued a written warning for the first offense; for any subsequent violations, upon conviction be subject to a fine of not less than $5 nor more than $50 and costs, including Town Attorney fees and Victim's Compensation Fund assessment. For a second or subsequent conviction, any person, firm or corporation shall, upon conviction, be subject to a fine of not less than $10 nor more than $100 and costs, including Town Attorney fees and Victim's Compensation Fund assessment. Each day that a violation of any of the provisions of this article continues shall be deemed and taken to be a separate and distinct violation.
