The Board of Supervisors is vested with the jurisdiction and control of the subdivision and development of land located within the limits of New Garden Township in accordance with the Pennsylvania Municipalities Planning Code, Act 247 of 1968, as amended.
A. 
No lot in a subdivision may be sold; no permit to erect, alter or repair any building upon land in a subdivision may be issued; and no building may be erected in a subdivision, unless and until a final subdivision plan has been approved and, where required, recorded; and until the improvements required by the Board in connection therewith have either been completed or guaranteed as hereinafter provided. Where, owing to special conditions, a literal enforcement of this provision would result in unnecessary hardship, the Board may make such reasonable exception thereto as will not be contrary to the public interest and may permit the sale of a lot, issuance of a permit, or erection of a building, subject to conditions necessary to assure adequate streets and other public improvements.
B. 
No lot, tract or parcel of land will be subdivided, and no land will be developed, and no street, alley, sanitary sewer, storm sewer, water main or related facility will be laid out, constructed, opened or dedicated for public use or travel, or for the use of occupants of buildings abutting or to abut on them, except according to the provisions of this chapter and the New Garden Zoning Ordinance and any other ordinances of the Township.
C. 
No section of this chapter shall be construed to prohibit condominium ownership as permitted by the Pennsylvania Uniform Condominium Act.[1]

D. 
The scope of this chapter shall include all matters over which, by law, the Township is authorized to exercise control by enactment and enforcement of this chapter, including but not necessarily limited to:
(1) 
All improvements within the tract undergoing subdivision or land development;
(2) 
The improvements of adjacent public facilities, including streets and drainage facilities which border upon the tract; and
(3) 
The installation or enhancement of off-site improvements needed to adequately serve the subdivision or land development.
