This article shall be cited and may be referred to hereafter as the "Sidewalk Cleaning Law of the Village of Airmont."
It is the intent of this article that all sidewalks in the Village of Airmont are maintained in a safe and passable condition.
The owner and occupant of premises abutting on any street where a sidewalk has been laid is hereby required to keep the sidewalk in front of said premises free and clear from snow, ice dirt and other debris or obstructions.

A. 
Such cleaning of snow and/or ice must take place within 48 hours from the time the snow, ice, dirt or other obstruction falls or is placed upon such sidewalk in any residential zoned district.
B. 
Such cleaning of snow and/or ice must take place within 24 hours from the time the snow, ice, dirt or other obstruction falls or is placed upon such sidewalk in any nonresidential zoned district.
In the event of the failure of the owner and occupant of said premises to clean said sidewalk and remove the snow, ice, dirt or other obstruction therefrom within the time above provided for, the Village Board may remove the same and charge the expense thereof to the owners of such premises. Said charge shall become a lien upon the premises benefited thereby until paid and, in addition thereto, the owner and occupant of said premises shall be personally liable for the payment thereof. All such charges which remain unpaid for more than 30 days shall thereupon be levied against the property in question as if a tax on said real property and in addition to other taxes, fees rents or charges which would otherwise be so levied.
The Police Department of the Town of Ramapo or any other Police Department then servicing the Village, and/or the Building Inspector or Code Enforcement Officer for the Village of Airmont, shall have the power, right and authority to issue an appearance ticket, as the same is defined in Article 150 of the Criminal Procedure Law of the State of New York, for the violation of any section of this article.
A. 
Any person violating any section or provision of this article shall be punishable by a maximum fine of $250.

B. 
In the case of continuing violation of this article, each day that such violation exists of this article shall constitute a separate and distinct offense.

C. 
In addition to the above-provided penalties and punishment, the Village Board may also maintain an action in the name of the Village of Airmont in any court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this article.
D. 
The remedies contained within this article shall further not be exclusive but shall be in addition to any other remedy provided by law or that of the Village Code of Airmont, so long as not inconsistent herewith, nor shall the invoking of any remedy or procedure contained within this article preclude the pursuit of any and all other remedies, and the same are intended to be cumulative.

The Village Board may also enforce obedience to this article and restrain violations thereof by injunction and may proceed against all violators hereof by any and every other means or method provided by law, although not herein specifically referred to.
