No driveway or lot entrance may be constructed in the borough along borough roads for a residential or other use not requiring site plan approval unless the owner first obtains a driveway permit from the borough. The applicant shall pay the borough a fee as set forth in Chapter
102, Fees.
Application for such a permit shall be accompanied
by a scaled plot map showing the proposed location and details of
the proposed driveway to be filed with the Zoning Enforcement Officer.
All driveways to be constructed shall be in accordance with the minimum requirements as set forth in Chapter
195, Subdivision of Land and Site Plan Review, §
195-45.
All driveways shall be constructed and maintained
at all times and in such a manner as to prevent erosion of the soil
from them and land behind them. Water and silt shall be prevented
from running onto roads, filling up road gutters, catch basins, inlets
or pipe drains.
All driveways shall be constructed so as not
to interfere with drainage along the existing road pavement or traveled
way.
No building permit shall be issued for the construction
or alteration of any structure where, inherent in any application
for such permit, a driveway permit is required in accordance with
the terms of this article until said driveway permit is issued.
Any person or persons, firm or corporation violating
any provision of this article which results in damage to or obstruction
of any public road, gutter, storm drain, ditch, basin, inlet or culvert
shall be responsible for all expenses incurred by the borough in repairing
said damage or removing said obstruction, in addition to any penalty
otherwise provided.

Any violation of the provisions of this article shall be punishable, upon conviction, according to the penalties provided in §
1-15 of this Code.
