The purpose of this article is to specify rules for the establishment and administration of a committee that will bring employers and employees together in a nonadversarial, cooperative and effective effort to promote safety and health at each municipal work site within the Town of Killingworth in accordance with the provisions of §§ 31-40v-1 through 31-40v-11 of the Regulations of Connecticut State Agencies, as the same may from time to time be amended or expanded.
For the purposes of this article, the following terms shall have the meaning indicated:
AVERAGE INCIDENCE RATE 
The average incidence rate of work-related injury and illness for all industries in this state as determined by the Department of Labor.
CHAIRMAN
The Chairman of the Municipal Safety and Health Committee or his/her designee or agent.
EMPLOYEE
Persons engaged in service to the Town of Killingworth in the business prescribed by the Town of Killingworth, whether said business and its functions, duties or responsibilities are compensated or volunteer.
EMPLOYER
The Town of Killingworth and/or any political subdivision thereof.
MANAGERIAL MEMBER
Any individual who has the authority to use his or her judgment in the interest of the employer to hire, transfer, suspend, lay off, recall, promote, discharge and assign employees, to direct them, or to adjust their grievances or effectively to recommend such actions.

There shall be a Municipal Safety and Health Committee created to supervise safety and health matters for all those acting on behalf of the Town of Killingworth.
A. 
The Committee shall consist of nine members, with one representative from each of the following groups and/or organizations:
(1) 
Killingworth Volunteer Fire Company.
(2) 
Killingworth Ambulance Association.
(3) 
Killingworth Municipal Employees' Association.
(4) 
Killingworth Town Hall Employees.
(5) 
Killingworth Transfer Station and Sludge Lagoons Employees.
(6) 
Killingworth Town Hall Employees who are not members of the Killingworth Town Hall Employees bargaining unit.
(7) 
The current Highway Foreman.
(8) 
The current First Selectman.
(9) 
Killingworth Library Association.
B. 
No more than 1/2 of the members of the Committee shall be managerial members The employer's nonmanagerial members shall select employee safety and health members.
C. 
The Chairman of the Committee shall be elected by a majority of the members. The Chairman may be either an employer or employee member.
The Committee shall meet at least once every three months but may meet more often should there be a need or should it so choose.
A. 
The Town of Killingworth shall keep a roster containing the names and departments of all Committee members. The names of current Committee members shall be posted to ensure that all employees can readily contact Committee members.
B. 
The Town of Killingworth shall keep a record of attendance and the minutes of all meetings.
C. 
All records regarding safety and health shall be provided to the Chairman of the Connecticut Workers' Compensation Commission or his/her designee.
D. 
The retention time for such records is three years, after which time such records may be retired or destroyed in accordance with guidelines established by the office of the Connecticut Public Records Administration.
Any employee who participates in Committee activities in his/her role as a Committee member, including but not limited to attending meetings, training activities, and inspections, shall be paid at his/her regular rate of pay for all time spent on such activities.

The Committee shall have the following duties and functions:
A. 
Safety inspections;
B. 
Investigating safety incidents, accidents, illnesses and deaths;
C. 
Evaluating accident and illness prevention programs;
D. 
Establishing training programs for the identification and reduction of hazards in the workplace which damage the reproductive system of employees; and
E. 
Establishing training programs to assist Committee members in understanding and identifying the effects of employee substance abuse on workplace accidents and safety.
All members of the Committee shall be trained as Committee members at no cost to the employee.

Any safety and health committee established under and operating in conformity with this article and under the provisions of §§ 31-40v-11 through 31-40v-11, inclusive, of the Regulations of Connecticut State Agencies is intended to respect all rights of employees, including those rights arising under the National Labor Relations Act and the Railway Labor Act, and any committee established under this article shall not be construed to constitute a labor organization within the meaning of Section 2(5) of the National Labor Relations Act or a representative within the meaning of Section 151, sixth paragraph, of the Railway Labor Act.[1]
