A. 
Any other provisions in these regulations to the contrary notwithstanding, no building or land shall be used for:
(1) 
On premises; distance between same uses. The sale or dispensing of any alcoholic beverage to be consumed on the premises if any public entrance to such building or land is within a radius of 1,000 feet from any public entrance to any other building or land used for the sale or dispensing of any alcoholic beverage to be consumed on the premises;
(2) 
Off premises; distance between same uses. The sale at retail of any alcoholic beverage other than ale or beer to be consumed off the premises if any public entrance to such building is within a radius of 1,500 feet from any public entrance to any other building or land used for the sale at retail of any alcoholic beverage other than ale or beer to be consumed off the premises; or
(3) 
On or off premises. The sale or dispensing of any alcoholic beverage to be consumed on the premises or the sale at retail of any alcoholic beverage to be consumed off the premises if such building or land is located in a rural residence district.
B. 
Existing licenses. Notwithstanding the foregoing provisions, the premises of any license for the sale at retail of alcoholic beverages to be consumed off the premises which existed at the effective date of these regulations may be moved within a radius of 500 feet, provided that the new location is within the same district as the old.
C. 
Gift basket/wine permit. Flower shops, florists, garden centers, nurseries, greenhouses, and similar retail stores may include wine products in a gift basket, floral arrangement, plant basket, or fruit/gourmet basket, provided that;

(1) 
Wine is limited to four bottles per basket.
(2) 
Consumption of the wine on the premises is not permitted.
(3) 
The wine is obtained from existing package stores or in-state farm wineries.
