As used in this chapter, the following terms shall have the meanings indicated:
BODIES OF WATER
The bodies of water covered by this chapter shall be the Red Cedar River, Rice Lake, Montanis Lake, Moon Lake, Stump Lake or any other body of water within the jurisdiction of the City of Rice Lake.
DOCK or WHARF
Any wood, metal, concrete or otherwise nonnatural structure erected, placed, constructed or built by the City of Rice Lake for recreational or economic purposes which abuts or extends into or on or over a body of water.
The City of Rice Lake may from time to time establish, build, erect, construct or place a dock or wharf adjacent to, abutting into or on or over a body of water to allow for the citizens of the City of Rice Lake to use said dock or wharf for recreational or economic purposes.
A. 
The City of Rice Lake may designate a particular use for any dock or wharf established, built, erected, constructed or placed by the city and may limit the particular uses of any dock or wharf to the exclusion of other uses. Such uses may include the mooring of watercraft, swimming, fishing, bait storage and commercial loading or unloading.
B. 
A dock or wharf owned by the City of Rice Lake and posted by any sign limiting or permitting specific use shall be used exclusively for the use permitted or the use not prohibited. Said uses shall be determined by recommendation of the Board of Parks, Recreation and Cemeteries and approved by City Council.
A. 
A minnow wharf is hereby established on the northern banks of the Red Cedar River on property owned by the City of Rice Lake abutting said river south of the city's impound lot and east of the city footbridge.
B. 
The purpose of the minnow wharf is to permit sport fishermen to store minnows and other natural bait in storage containers in the Red Cedar River. Use of the minnow wharf is limited to recreational fishermen only, and it may not be utilized by any commercial interest or establishment.
C. 
Minnow wharves are for the exclusive use of City of Rice Lake permit holders and may not be used for swimming, fishing, sunbathing, mooring of watercraft or any other use.
D. 
No person not holding a City of Rice Lake minnow wharf permit may be on or upon said wharf unless accompanied by a permit holder.
E. 
The permit shall be applied for and shall be issued by the Department of Parks, Recreation and Cemeteries of the City of Rice Lake for an annual fee as set forth in the fee schedule adopted as part of the annual budget document. Permits shall entitle the permit holder to place bait storage facilities adjacent to the minnow wharf subject to the regulations set forth herein.
(1) 
The permit holder may have one or two bait storage installations. Installations shall be no larger than the volume and diameter of the height of a standard fifty-five-gallon drum.
(2) 
All storage installations must be secured no less than four inches from the minnow wharf and no less than six inches from any other installation permitted by the city.
(3) 
No storage containers may be anchored in any manner to the wharf itself.
(4) 
The colors of the storage containers and stakes shall be a natural green color approved by the Department of Parks, Recreation and Cemeteries.
(5) 
The Department of Parks, Recreation and Cemeteries, upon inspection of the minnow wharves and the installations of the permittees, may from time to time require maintenance or upkeep in order to preserve the health, safety and aesthetics of the minnow wharf and persons using said wharf.
(6) 
Each bait storage container shall have printed on the top surface of the container in clearly visible and legible printing the name and address of the owner and the city permit number.
F. 
Any person holding a valid permit to use said minnow wharf who fails to comply with the terms and conditions of usage as set forth in this chapter, or as may from time to time be established by the Department of Parks, Recreation and Cemeteries, shall be subject to the penalty section of this chapter as well as being subject to revocation of the permit. Any person not holding a permit who uses the minnow wharves in violation of the provisions of this chapter shall be subject to the penalty provisions of this chapter.
G. 
The City of Rice Lake shall not be liable for the maintenance, security or care of the bait storage containers placed by permit holders, nor shall the city be responsible or liable for any loss sustained by a permit holder as a result of the violation of this chapter by any person. The City of Rice Lake is further not liable for any injuries or property damage sustained by any person who attempts to use the wharves established by this section in violation of the terms and conditions of this section.

Any person who shall violate any provisions of this chapter shall, upon conviction thereof, forfeit no less than $15 and no more than $200, together with costs and penalty assessment and costs of prosecution, and, in default of payment of said forfeitures, costs and penalty assessment, shall be jailed in the county jail until such forfeiture and costs are paid in full, but not exceeding 90 days.
