The provisions of this chapter shall be severable,
and if any of its provision shall be held to be unconstitutional,
illegal or otherwise invalid, that decision shall not affect the validity
of any of the remaining provisions of this chapter. It is declared
as a legislative intent that this chapter would have been enacted
had that unconstitutional, illegal or otherwise invalid provision
not been included in this chapter.
The provisions of this chapter, so far as they
are the same as those of ordinances and regulations in force immediately
before the enactment of this chapter, are intended as a continuation
of those earlier ordinances and regulations, and are not new enactments.
Nothing in this chapter shall affect any act done or liability incurred,
or any suit or prosecution pending or to be instituted under any of
those repealed or superseded ordinances or regulations.
A.
The following ordinances of the Township of Mahoning
are repealed:
(1)
Ordinance dated August 14, 1978, regulating traffic
and parking in the Township of Mahoning.
(2)
Ordinance dated April 14, 1965, regulating traffic
and parking in the Township of Mahoning (Rt. 45).
(3)
Ordinance dated April 14, 1965, regulating traffic
and parking in the Township of Mahoning (driveways and fire hydrants).
B.
All prior ordinances of the Township of Mahoning in
so far as they deal with the regulation of traffic and/or parking
are repealed and declared unenforceable in so far as they are inconsistent
with or identical to any provision of this chapter.
This chapter shall take effect November 13,
1989.
