This article, entitled "Town of Concord Data File Request," shall apply to data in the possession of the Town of Concord Assessor's Office and the use of and demand for data by any party whomever.

The Town Board of the Town of Concord desires to hereby create a means to allow for a fee schedule to be imposed for any person, persons, corporation or government agency requiring use of or deliverance of data of any or all real property contained within the Assessor's Office within this Town. It is the intent of the Town Board of the Town of Concord to recover all actual costs incurred for any special services performed by employees of the Town with regard to the aforementioned real property data in the Town's possession.
A. 
All requests for data must be in writing. The requesting party understands and so stated that a fee will be imposed for any and all ordinary and extraordinary costs associated with complying with said request. Chargebacks by the Town shall include such items as field surveys, mileage, film, copying costs (as prescribed by state law), secretarial time and time spent by the Town Assessor. All calculations for personal time shall include actual salaries and benefits applicable to each utilized employee at the time of such request. Any other incurred expense not stated herein shall be charged back at the actual cost born by this Town.

B. 
Prior to the commencement of producing data for any request, the party or parties making the request must state in writing that said request shall be paid for in full prior to receiving said data.
A. 
No real property data shall be delivered to or given to any parties without prior knowledge of the Town Board and approval of the same Town Board.
B. 
Normal freedom of information requests shall not be subject to the provisions of this article.
C. 
The Town Board shall be the only party to receive information requests as applicable within this article.
The Town Board or its duly appointed designee shall monitor provisions contained herein and ensure enforcement. Any violations of these provisions shall cause said Town Board to take administrative action against any persons not complying with any section of this article.
