The purpose of this chapter is to protect the
public health, welfare, safety, peace and tranquility by regulating
the operation of snowmobiles, off-road motor vehicles and unauthorized
motor vehicles upon trails and public land within the Town of Victor.
The Town Board of the Town of Victor finds and
hereby determines that the regulation of snowmobiles, all-terrain
vehicles, motorbikes and other motorized vehicles is necessary as
these activities pose a serious concern to the maintenance and integrity
of the Town's trail system, creates a risk to public safety and causes
public inconvenience by creating undue noise.
As used in this chapter, the following terms
shall have the meanings indicated:
OFF-ROAD MOTOR VEHICLE
Any vehicle which is propelled by any power other than muscular
power, except electrically driven mobility devices operated by a person
with a disability, pedal-assist (Class 1) electric bicycles with maximum
speeds of 20 miles per hour (mph), vehicles authorized by the Town
to repair or maintain premises and emergency vehicles, that is designed
specifically for operation on unpaved surfaces and is operated off
of the public highways and on unpaved surfaces.

OPERATION
To drive or propel, or cause any vehicle defined by this
chapter to move by any power other than muscular.
SNOWMOBILE
Any self-propelled vehicle designed for travel on snow or
ice, steered by skis or runners and supported in whole or in part
by one or more skis, belts or cleats.
SPECIAL EVENT
An organized snowmobile or off-road vehicle event of limited
duration which is conducted according to a prearranged schedule and
in which the general public's interest is manifested.
It shall be unlawful for any person to operate
any snowmobile or off-road motor vehicle on private lands within the
Town of Victor without first obtaining the landowner's consent.
It shall be unlawful for any person to operate
any snowmobile or off-road motor vehicle on lands owned by the Town
of Victor without the express consent of the Victor Town Board by
permit. Any operation must be in accordance with all applicable laws
of the State of New York, including the requirement of registration
and insurance, and in accordance with any conditions set forth by
the Town Board. It shall further be unlawful for any person to operate
any motor vehicle of any nature upon Town trails without the consent
of the Town of Victor Parks and Recreation Department.
Other than as provided in this chapter, snowmobiles
and off-road vehicles may be operated within the Town of Victor in
places and manner as are not inconsistent with provisions of the laws
of the State of New York.
The Town of Victor Parks and Recreation Department
may from time to time sanction and organize special events for which
activity of snowmobiles and other off-road motor vehicles is allowed.
The applicant shall apply to the Town of Victor Parks and Recreation
Department for a special permit to participate in such events upon
rules and regulations so promulgated by the Town of Victor Parks and
Recreation Department.
Failure to comply with the provisions of this
chapter shall be deemed a violation, and the violator, upon conviction
thereof, shall be punishable by a fine of not more than $250, or by
imprisonment of not more than 15 days, or both, and each day a violation
continues shall be deemed a separate and distinct offense.
