The purpose of this article is to eliminate
the requirement that an individual be an elector or reside in the
Town of Batavia, New York, in order to accept and/or hold the position
of Town Manager.
In the Town of Batavia, Genesee County, the
provisions of Public Officers Law § 3, Subdivision 1, and
Town Law § 23 requiring a person to be a resident or elector
of the Town of Batavia shall not prevent a person from holding the
office of Town Manager provided that such person resides in the State
of New York.
