The Town Board may from time to time, on its
own motion, or on petition or upon recommendation of any board of
the town, amend, supplement or repeal any or all of the regulations
and provisions of this chapter. Every such proposed amendment or change
may be referred to the Zoning Board of Appeals and/or the Planning
Board for written report before the public hearing hereinafter provided
for.
The Town Board, by resolution adopted at a stated
meeting, shall fix the time and place of a public hearing on the proposed
amendments and cause notice thereof to be given as follows:
A. By publishing a notice once a week for two consecutive
weeks in at least one newspaper of general circulation in the town,
the first of which shall be published not less than 10 days prior
to the hearing.
B. The notice shall state the general nature of the proposed
amendment.
Whenever the owners of 50% or more of the street
frontage in any district, or specified part thereof, shall present
to the Town Board a petition duly signed and acknowledged, in form
approved for deeds, requesting an amendment, supplement, change, modification
or repeal of the regulations prescribed, or a change in the boundaries
shown on the Zoning Map, including said district or specified part
thereof, it shall be the duty of the Town Board to hold a public hearing
in the manner prescribed above.
In the case, however, of a protest against any
change, signed by the owners of 20% or more either of the area of
the land including such proposed change, or of that immediately adjacent
extending 100 feet therefrom, or of that directly opposite thereto
extending 100 feet from the street frontage of such opposite land,
such amendment shall not become effective except by the favorable
vote of four members of the Town Board.
