A. 
General requirements. All driveways shall be located, designed, constructed, and maintained in such a manner as not to interfere or be inconsistent with the design, maintenance and drainage of the street.
B. 
General location restrictions. All driveways shall be permitted at locations in which:
(1) 
Sight distance is adequate to safely allow each permitted movement to be made into or out of the access driveway;
(2) 
The free movement of normal highway traffic is not impaired;
(3) 
The driveway will not create a hazard; and
(4) 
The driveway will not create an area of undue traffic congestion on the highway.
(5) 
Adequate sight distance at all driveways shall conform to PennDOT latest Publication 282 (Highway Occupancy Permit Handbook) and Pennsylvania Code Title 67, Transportation, Chapter 441 (Access to and Occupancy of Highways by Driveways and Local Roads).
C. 
Residential Driveway Drawing No. 11.2.5 (SD-01). Within the right-of-way of Township streets, residential driveways shall be constructed in accordance with Drawing No. 11.2.5, Residential Driveway Detail.
D. 
Grade. Driveways shall be constructed to conform to the grade of the finished shoulders. All descending or ascending grades of driveways greater than 4% shall begin at the street right-of-way. No stormwater shall be permitted to drain onto Township streets.
Before the construction of any driveways, the permittee shall file with the Supervisors of Brighton Township an application in form prescribed by said Supervisors, setting forth the name of the applicant, the name of the contractor, the place of construction, the type of construction and all information set forth in § 175-34 above. Such application shall be accompanied by payment in the amount set forth in the fee resolution adopted and amended from time to time by the Board of Supervisors to cover the costs of the permit processing and inspections hereinafter set forth.
Any person who shall violate any terms of this article or who shall fail to design, construct, or maintain as provided in this article shall, upon conviction thereof in a summary proceeding, pay a fine of not more than $500 for each such offense, together with the cost of restoring such driveway, and in default of the payment of such fine and costs shall be sentenced to imprisonment of not more than 10 days. All fines and costs so recovered shall be paid to the Township Treasurer.
