No organizations or groups of persons exceeding
25 people shall be permitted to camp or hold group picnics or outings
of any nature at the Cove Area of Hamilton Township unless such organizations
or groups shall first obtain a permit for that purpose, which permit
shall be approved and issued by the Township Administrator or their
designee. The Cove Area shall include the beach, water to the safety
rope, the parking area and the entire area between the beach and Park
Road.

A. Fees for seasonal use of the Cove Area during the
season consisting of the date upon which the Cove Area is officially
opened for the season for swimming through the date of its closure
that season shall be the following:

(1) $25
per person if purchased on or before April 30.
(2) $30
per person if purchased on or after May 1.
(3) $100
for a package of four only when purchased in a single transaction.
B. Fees for daily use of the Cove Area during the season
consisting of the date upon which the Cove Area is officially opened
for the season for swimming through the date of its closure that season
shall be the following:

(1) Weekends
and holidays (Saturday, Sunday, and holidays): $15 per person per
day.
(2) Weekdays:
$10 per person per day.
C. No fees shall be charged or collected from children
under 12 years of age.
D. No fee shall be charged or collected from any veteran or member of
any branch of the United States Military. For purposes herein, a veteran
shall be a person who has previously been a member of any branch of
the military of the United States of America, including, without limitation,
the U.S. Army, U.S. Marine Corps., U.S. Navy, U.S. Air Force, the
Coast Guard and any officially recognized subdivision thereof. Active
military members shall mean any individual who is currently/presently
engaged in any branch of the Armed Forces, as set forth in the previous
sentence.

E. Fees for
reservation of picnic tables and grills in the Cove Area the season
consisting of the date upon which the Cove Area is officially opened
for the season for swimming through the date of its closure that season
shall be the following:

(1) Picnic
package consisting of one grill and one picnic table, $50 per day,
per package. Reservations must be made and paid in full at least 24
hours in advance.
No alcoholic beverages shall be brought to or
consumed at any time within the Cove Area.
No open fires shall be permitted at any time
at the Cove Area.

All bathers must wear proper bathing attire
at all times.

All persons within the Cove Area must place
refuse and trash in proper receptacles, including designated containers
for recyclables.
Damage in any way to trees or other vegetation
within the Cove Area is strictly prohibited.
The use of boats, motorized water vehicles (including,
by description but not limitation, jet skis) or canoes within the
Cove Area is prohibited.

The use of flotation devices other than properly
sized and properly attached United States Coast Guard approved Types
I, II or III personal flotation devices is prohibited within the Cove
Area.

The parking of vehicles within the Cove Area
shall be restricted to parking lots and other areas to be designated
by the Township Administrator or their designee for that purpose,
and parking in all other areas is prohibited.
It shall be unlawful to drive any vehicle through
the Cove Area other than the designated parking lots and drive areas.
All speed limits posted therein shall be strictly observed.
It shall be unlawful to damage, destroy, mutilate
or deface in any manner whatsoever any and all public property within
the Cove Area, including, by description but not limitation, picnic
tables and chairs, lifeguard stands, grills and rest room facilities.
The washing of any vehicles in or at the Cove
Area is strictly prohibited.
No boat, motorized water vehicle as defined
herein or canoe shall be launched from the Cove Area, including both
bathing and parking areas, nor moored, anchored or operated within
200 feet of the shoreline with respect to lands owned by the Township
of Hamilton.
No waterskiing shall be permitted within the
Cove Area.

The Cove Area shall be closed to all persons
except for those dates and times posted as designated by the Township
Administrator or their designee.

The Township Committee may, by ordinance, fix
the fees for parking in parking lots at the Cove Area and for the
use of the grounds or any part thereof by groups for picnics or outings.

Swimming or bathing are only permitted in designated
beach areas. No person shall swim or bathe in any area other than
the designated beach area. No person shall swim or bathe in the designated
area while lifeguards are not on duty.
Any person or persons violating any section
of this article shall, upon conviction before a court of competent
jurisdiction, be subject to a fine not exceeding $200 or imprisonment
for a term not exceeding 30 days, or both such fine and imprisonment,
in the discretion of the court.
All ordinances and parts of ordinances of Hamilton
Township heretofore adopted that are inconsistent with any of the
terms and provisions of this article are hereby repealed to the extent
of such inconsistency. Specifically, this repealer shall include the
repeal of Ordinance No. 243, Ordinance No. 249, Ordinance No. 250,
Ordinance No. 265, Ordinance No. 782-80, Ordinance No. 826-82, Section
5 of Ordinance No. 380 and any and all other ordinances heretofore
referred to as "Chapter 83 of the Code Book of the Township of Hamilton."
