In all R3-TH Residence Districts the following uses of land and buildings are permitted:
A. 
All uses permitted in the R-3 Residence District, provided that the requirement of § 180-37 is met.
B. 
Townhouses, provided that the standards and conditions set forth in § 180-38 are satisfied.
A. 
In all R3-TH Residence Districts the area restrictions and regulations shall be the same as those permitted in the R-3 Residence Districts, except that the average lot area shall not be less than 14,000 square feet; provided, however, that the Planning Board may reduce the average lot size from 14,000 square feet, but not below 12,000 square feet, appropriately as part of the site plan or subdivision review process. The calculation of the average as it affects certain land subject to the settlement agreement referred to above (§ 180-17) shall be in accordance with the terms thereof.
B. 
For reverse frontage lots and corner lots, a four-foot-high berm in a landscape buffer of sufficient width shall be required along a major thoroughfare, designed in accordance with the standards of § 158-26.

In all R3-TH Residence Districts the height restrictions and regulations shall be the same as those permitted in the R-3 Residence District.
Any application for development for single-family detached residential dwelling units in the R3-TH Residence District is subject to a financial contribution by the developer in accordance with a settlement agreement dated April 27, 1987, providing for a payment in lieu of the construction of dwelling units for low- and moderate-income housing as defined by the New Jersey Council on Affordable Housing pursuant to the Fair Housing Act, N.J.S.A. 52:27D-301 et seq.
In all R3-TH Residence Districts townhouse structures for single-family residential use are permitted, provided that the approving body finds that the townhouse application:
A. 
Contains a minimum of 15 acres.
B. 
Is located adjacent to and has a minimum of 400 feet of frontage on an existing street.
C. 
Is subject to a financial contribution by the developer in accordance with a settlement agreement dated April 27, 1987, providing for a financial payment in lieu of the construction of dwelling units for low- and moderate-income housing as defined by the New Jersey Council on Affordable Housing pursuant to the Fair Housing Act, N.J.S.A. 52:27D-301 et seq.
In all R3-TH Residence Districts the following density, area, open space and height restrictions and regulations are established:
A. 
Density. The total number of townhouses proposed for development shall not exceed six townhouses per gross acre and shall not exceed a total of 200 townhouses in the R3-TH Residence District.
B. 
Area, open space and height restrictions. The area, open space and height restrictions shall be the same as those permitted in the RLC Residence District, § 180-55 herein, with the following exceptions:
(1) 
Minimum lot area per townhouse: 3,000 square feet.
(2) 
Maximum units per townhouse structure: eight.
(3) 
Building height: 35 feet measured in accordance with the standards set forth in the definition of "height of building" in § 180-2 herein.
