Sidewalks shall be located as follows:
A. Sidewalks shall be located within the right-of-way, with
the edge of the sidewalk being at the right-of-way line.
B. The elevation of sidewalks shall be the curb elevation
plus 1/4 inch per foot for the distance measured from the curb to the nearer
edge of the sidewalk. Where no curb exists, the elevation of the crown of
the roadway shall be used in place of the curb elevation. Where no grade is
available or where local conditions warrant deviation from the above, the
Town shall establish the sidewalk grade as well as the sidewalk line.
C. Driveways shall be so constructed or graded that the
level thereof shall not be in conflict with the requirements for sidewalks
established herein.
D. The Town may direct that sidewalks be located otherwise
than as prescribed above when such other location is necessary to make connection
with any existing sidewalks.
No sidewalk shall be constructed, reconstructed, repaired or graded
on any street, road or avenue in the Town of Clarence until a written permit
therefor shall have been obtained from the Town Clerk, which permit shall
determine and specify the slope, grade, width and location thereof, or until
an order shall issue, pursuant to the provisions of § 200-a of the
Town Law, directing such construction in conformance with these specifications.

A. The owner or occupant of any premises fronting or abutting on
any street or highway shall repair, keep safe and maintain any sidewalk abutting
the premises and kept it free and clear from snow, ice, dirt or other obstruction.
All trees, shrubs, plants and other vegetation must be cut back to a height
of eight feet directly above the surface of any sidewalk. Any such owner or
occupant shall be primarily liable for any death, injury or damage by reason
of omission or failure to repair, keep safe and maintain such sidewalk or
to remove snow, ice or other obstructions therefrom or negligence in performing
those functions.
B. No person shall plow, shovel, sweep or pile snow, ice or other
materials in or beyond the right-of-way of any street or public highway or
cause such to be done so as to interfere with the safety and convenience of
public travel.

A. Any violation by a person, firm or corporation of any provision
of this article shall be deemed a violation punishable by a fine not to exceed
$250 or by imprisonment for a period not to exceed 15 days, or both.
B. The provisions of this article shall be enforced by an appointed
Zoning Officer, Building Department Officer or any person designated or appointed
by the Town Board.
