§ 103.1 The Fire Marshal and
assistants. The Fire Marshal of East Caln Township, herein
called "Fire Marshal," shall be appointed by the Township Manager
and shall serve for such period and upon such terms and conditions
as the Manager shall direct. The Fire Marshal shall be responsible
for the direct administration and enforcement of this code.

§ 108.1. General. The
Township shall, by agreement with one or more other municipalities,
form an intergovernmental Board of Appeals which Board shall hear
and decide appeals of orders, decisions or determinations made by
the respective municipalities' building official relative to the application
and interpretation of the municipalities' building code. The members
of the intergovernmental Board of Appeals shall be appointed by the
participating municipalities and shall be governed by rules and regulations
adopted by the participating municipalities. The intergovernmental
Board of Appeals shall adopt rules of procedures for conducting its
business.

§ 109.3 Violations and penalties. Any person who violates or permits the violation of any provision
of this article or who shall fail to comply with any of the requirements
thereof or who shall erect, construct, alter or repair any building
or structure in violation of either an approved plan, a directive
of the Building Official or of a permit or certificate issued under
the provisions of this chapter shall, upon conviction thereof in a
summary proceeding brought before a Magisterial District Judge under
the Pennsylvania Rules of Criminal Procedure, be guilty of a summary
offense and shall be subject to the payment of a fine of not less
than $250 and not more than $1,000, plus court costs of prosecution.
In default of payment thereof, the defendant may be sentenced to imprisonment
in the County Prison for a term of not more than 90 days. Each section
or provision of this chapter that is violated shall constitute a separate
offense, and each day or portion thereof in which a violation of this
chapter is found to exist shall constitute a separate offense, each
of which violations shall be punishable by a separate fine imposed
by the Magisterial District Judge of not less than $250 and not more
than $1,000, plus costs of prosecution, or upon default of payment
thereof, the defendant may be sentenced to imprisonment in the County
Prison for a term of not more than 90 days. All fines and penalties
collected for the violation of this chapter shall be paid to the Township
Treasurer.

§ 111.4. Failure to comply. Any person who shall continue any work after having been served
with a stop-work order, except such work as that person is directed
to perform to remove a violation or unsafe condition, shall be subject
to the penalty provision of § 109.3.

§ 307.1.1 Where prohibited. No person shall cause, allow, permit, kindle, ignite or maintain
any bonfire, junk fire, refuse fire, open fire, salvage operations
or any other open fire on or in any public street, road, public ground,
or upon any property in East Caln Township.

Exceptions:

(a)
|
Field fires to clear land when approved by the
Code Official. An operational permit shall be obtained from the Fire
Marshal in accordance with § 105.6 prior to the event.

(b)
|
Demolition of the residue of a structure partially
destroyed by an accidental fire, when approved by the Fire Marshal
in accordance with § 105.6 prior to the event.

(c)
|
Gas-fired or charcoal grills.

(d)
|
Fire for training purposes or for the demolition
of a fire hazard under the supervision of the Fire Marshal. An operational
permit shall be obtained from the Fire Marshal in accordance with
§ 105.6 prior to the event.

(e)
|
High temperature controlled burning of construction
and road work debris, including trees, stumps and brush from land
clearing activities, when undertaken by a building contractor or road
construction contractor, utilizing a high temperature control device
approved by the fire code official or other regulatory agency. An
operational permit shall be obtained from the Fire Marshal prior to
the event. A separate permit shall be required for each construction
site or road project, or phase thereof, as determined and directed
by the Fire Marshal.

(f)

Manufactured appliances, approved by the Fire
Marshal, may be utilized for contained outdoor burning for recreational
purposes for any single property. These appliances may include, inter
alia: a gas-fired outdoor fireplace; gas-fired logs; a chimenea; above-ground
outdoor firepit with ember screen; provided the burning of leaves,
rubbish or trash in these devices is strictly prohibited.

§ 2703.1.5 Radioactive material. Unless preempted by requirements of any federal or state agency,
the requirements of NFPA 801 and this chapter shall apply to the storage
of any radioactive materials.

§ 506 Key boxes, security padlocks,
and Fire Department connection security caps
|
§ 506.1 Where required. Any occupancy within East Caln Township that is protected by an
automatic fire suppression, standpipe system, automatic alarm system,
and/or access to the occupancy or portion thereof is secured to the
point that immediate access is not available for life-saving or fire-fighting
purposes shall be equipped with a Fire Department key box. The key
box shall be at a location approved by the East Caln Township Fire
Marshal and/or Building Official. The key box shall be a UL type and
size approved by the Fire Marshal and/or Building Official and may
be required to be connected to the building's alarm system via a tamper
switch.

§ 506.1.1 Keys required. The key boxes shall contain the following:
|
(a)
|
Keys to locked points of egress, whether in
interior or exterior of such buildings;

(b)
|
Keys to the locked mechanical rooms;
| |
(c)
|
Keys to the locked elevator rooms;
| |
(d)
|
Keys to the elevator controls;
| |
(e)
|
Keys to any fence or secured areas;
| |
(f)
|
Keys to any other areas that may be required
by the Fire Marshal and/or Building Official;
| |
(g)
|
A card containing the emergency contact people
and phone numbers for such building;

(h)
|
Floor plan of the rooms within the building
may be required by the Fire Marshal and/or Building Official.

§ 506.1.2 Key box maintenance. The operator of the building shall immediately notify the Office
of Life Safety and Code Enforcement and provide new keys in accordance
with § 506.1.1 when an occupancy's lock is changed or rekeyed.
The key to such lock shall be secured in the key box.

§ 506.1.3 Security padlocks. When a property is protected by a locked fence or gate and where
immediate access to the property is necessary for life-saving or fire-fighting
purposes, the Fire Marshal and/or Building Official may require a
security padlock to be installed at a location approved by the Fire
Marshal and/or Building Official. The security padlock shall be UL
type and size approved by the Fire Marshal and/or Building Official.

§ 506.1.3 Security caps. When a building is protected by an automatic sprinkler system or
standpipe system and the Fire Department connection is exposed to
undue vandalism the Fire Marshal and/or Building Official may require
that a Fire Department connection security cap(s) be installed. The
Fire Department connection security cap(s) shall be a type approved
by the Fire Marshal and/or Building Official.

§ 506.2 Time for compliance. All existing buildings shall comply with this section nine months
from its effective date. All newly constructed buildings not yet occupied
or buildings currently under construction, and all buildings or businesses
applying for a certificate of occupancy, shall comply prior to said
certificate being issued by the Office of Life Safety and Code Enforcement.
