It is the purpose of the Town Board to protect and preserve in a reasonable manner the health, comfort and environment of the residents and employees of the Town of Guilderland by the regulation of smoking tobacco in buildings owned by the Town of Guilderland, New York.
For the purpose of this chapter, the following terms shall have the following meanings:
BUILDINGS OWNED BY THE TOWN OF GUILDERLAND
Any structure which is leased by the Town of Guilderland or to which the Town of Guilderland has fee simple title.
SMOKING
Includes the burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco.
It shall be unlawful for any person to smoke tobacco in any form in any buildings owned by the Town of Guilderland except in permitted smoking areas.
The Town Board is hereby empowered to designate, from time to time, by order or resolution, an area or areas within any building owned by the Town of Guilderland where smoking shall be permitted.
A person who violates the provisions of this chapter is guilty of a violation punishable by a penalty as set forth in Chapter 1, General Provisions, Article III.
