This article shall be known as the "Village of Head-of-the-Harbor Garbage
Disposal Ordinance."
As used in this article, the following terms shall have the following
respective meanings:
GARBAGE
Shall have the meaning ordinarily attributed to that term and shall
include wastepaper, ashes, bottles, cans and other waste and discarded materials.
GARBAGE CAN
A container designed and used for the storage of garbage pending
removal, and shall be made of such material and so constructed that it cannot
easily be broken into and, except when empty, so closed that it cannot easily
be opened by any animal, wild or domestic, customarily found in the Village,
and also of such weight or size or so secured that it cannot easily be removed
by any such animal.
OWNER
The owner of land located in the Village and any tenant or subtenant
in possession of such land.
PERSON
An individual, partnership, voluntary association or corporation.
RUBBISH
Broken or burnt parts of furniture, machinery or other articles intended
for disposal but too large to be contained in a garbage can.
No person shall throw, place or deposit any garbage or rubbish on any
public road or other property of the Village or on any land of which he shall
not be the owner.

A. No owner or occupants of any lot shall permit that property's
garbage to be deposited on their land outside of a building except when contained
in a garbage can.
B. Garbage cans shall not be placed along the side of any
of the highways of the Village, except upon the day when garbage collection
is scheduled, and any garbage can so placed for collection shall be removed
from the side of the highway within 12 hours after collection of garbage has
been made.
C. Whoever places garbage along any of the highways of the
Village and such garbage shall be broken into or overturned, and the contents
thereof shall become scattered on or along the side of such highway or onto
the adjoining lots or premises, shall be responsible for the removal of the
same, which shall be promptly done, or, in default thereof, the Village officials
who are authorized to issue appearance tickets shall cause the same to be
removed and charge the expense thereof to whomever shall have placed the garbage
along the highways of the Village.

Anyone who violates any provision of this Article shall be subject to
a fine or imprisonment, up to the maximum that may be imposed by a Village
court, or both.
