The use of speed-timing devices, as defined
and set forth in the Vehicle Code of Pennsylvania and the regulations
promulgated pursuant thereto, is hereby approved in and for Malvern
Borough to aid in the enforcement of speed restrictions applicable
within the borders of the Borough, and the peace officers of Malvern
Borough are hereby authorized and directed to use approved speed-timing
devices to aid in the enforcement of speed restrictions applicable
within the borders of Malvern Borough.
All types of speed-timing devices permitted
by the Vehicle Code of Pennsylvania and regulations promulgated pursuant
thereto, as the same may be amended from time to time to be used by
the peace officers of Malvern Borough, are hereby approved by the
Borough Council of the Borough of Malvern for such use. The speed-timing
devices hereby approved include mechanical and electrical speed-timing
devices as set forth in the Vehicle Code, provided that the same shall
be of the type approved by the Department of Transportation, all as
set forth in the Act of June 17, 1976, P.L. § 162, No. 81,
§ 1; 75 Pa.C.S.A. § 3368, and include by way of
example the electrical equipment set forth in Section 105.51 of Title
67 of the Pennsylvania Code, including the Electrical Speed-Timing
System manufactured by Richard Hageman; the Model TK100 Excessive
Speed Preventor manufactured by Systems Innovation, Inc.; Speed Chek,
manufactured for the Union Agency, and electrical-mechanical equipment
as set forth in Section 105.91 of Title 67 of the Pennsylvania Code,
including VASCAR-Plus manufactured by Traffic Safety Systems, Inc.
and Enradd EJU-91 Wireless System manufactured by Y.I.S. Incorporated,
listed in the Pennsylvania Bulletin Volume 33, Number 31, August 2,
2003, pages 3719-3980.
The Borough may, in its sole discretion, elect
to post legible signs giving public notice of the use of speed-timing
devices in Malvern Borough at or near the public highways at the boundaries
of or within Malvern Borough. The absence of such posting shall in
no way be deemed a defense to any prosecution based in whole or in
part upon the use of any speed-timing device.
