Any resident of the Township of Pilesgrove intending to dispose of Type 13 demolition waste in the Woodstown-Pilesgrove Municipal Landfill shall obtain a permit to dispose of such materials in excess of three cubic yards per week. The ultimate responsibility for obtaining such a permit shall be with the property owner of those lands or premises from which the demolition-type waste is to be removed. All permits shall be obtained by making an appropriate application to the Pilesgrove Construction Code Official and upon payment of all required fees in advance. For purposes of this article, the term "resident" shall include the person or corporation making the application or any person or corporation acting on his or its behalf or providing a construction or demolition service on his or its behalf.
All permits that are issued shall specifically designate the quantity of Type 13 demolition waste to be deposited in the Woodstown-Pilesgrove Municipal Landfill. This permit shall be presented to the landfill operator each time Type 13 demolition waste is presented for disposal. The landfill operator shall record the quantity of waste deposited pursuant to each permit. In no event shall any Type 13 demolition waste be deposited in the Woodstown-Pilesgrove Municipal Landfill in excess of the amount set forth on the permit. Any resident having to deposit more demolition type waste than provided for in the permit shall make an application to the Construction Code Official for a supplemental permit to provide for such additional disposition as may be necessary. Such a permit shall be issued upon the payment of any additional fees required.
The fee for a Type 13 demolition waste permit shall be $10 plus a fixed charge per cubic yard of Type 13 demolition waste to be deposited in the Woodstown-Pilesgrove Municipal Landfill. The specific charge per cubic yard shall be determined by resolution of the Township Committee and may be adjusted from time to time. In no event shall this fee be an amount in excess of the sum charged by the landfill operator, plus a reasonable allowance for landfill closure taxes and escrow payments required by the State of New Jersey.
Any person violating this article or any regulations promulgated pursuant to this article shall be subject to a fine not to exceed $1,000, unless some other penalty is expressly provided by the New Jersey Statutes. In addition to any penalty assessed herein, any person found guilty of violating this article shall also pay all permit fees that would have been paid and required of the defendant if a valid permit had been obtained.
