Every owner of property within the Borough of Tullytown shall, on 30 days' notice from the Borough Council, construct or reconstruct a sidewalk, which shall conform to all applicable requirements of this article, in front of and/or alongside such property.
Every owner of property in the Borough of Tullytown shall, on 30 days' notice from the Borough Council, repair the sidewalk, in the manner stipulated in such notice, in front of and/or alongside such property.
All sidewalks shall be constructed, reconstructed and repaired of concrete only, according to specifications determined from time to time by the Borough Engineer; provided that, where an existing sidewalk was lawfully constructed of a material other than concrete, such sidewalk may be repaired of the same material, but where the condition of any such sidewalk shall be such, in the opinion of the Borough Engineer, that reconstruction, rather than repair, is necessary, then such sidewalk shall be reconstructed of concrete.
All sidewalks hereafter constructed shall be paved to a width of four feet.
All sidewalks shall be constructed, reconstructed and repaired and the grading therefor shall be done upon the line and grade obtained by the property owner from the Borough Engineer, and not otherwise.
It shall be the duty and responsibility of the Borough Engineer to determine, in the case of any individual property, whether or not the sidewalk shall be constructed or repaired, and, if so, the specific part or parts thereof to be reconstructed or repaired. The Engineer, at any time, during the course of constructing, reconstructing or repairing any sidewalk, may visit the site of such work in order to ascertain whether such work is being done according to requirements, and he, or a person delegated by him for the purpose, shall visit any such site for such purpose whenever requested by the property owner. Within two days after the completion of the work of construction, reconstruction or repair of any sidewalk, it shall be the duty of the owner of the property where such work was done to notify the Borough Engineer of that fact, so that he may inspect such sidewalk to determine whether the lines and grades thereof have been observed and followed.
Any property owner, upon his own initiative, and without notice from any Borough authority, may construct, reconstruct or repair a sidewalk in front of or alongside his property, provided that such owner shall first make application to the Borough Engineer, and shall conform to the requirements of this article as to line and grade and as to material used, and that he shall also notify the Borough Engineer, as required by § 151-20 of this article, within two days after completion of the work.
Upon the neglect of any property owner to comply with any of the requirement of this article as to construction, reconstruction or repair of a sidewalk, the Borough may, after 10 days' notice to such owner, cause such work of construction, reconstruction or repair, as the case may be, to be done at the expense of such owner, and may collect the cost thereof, with 10% additional, from such owner in the manner prescribed by law; provided that this section shall also apply to the remedy or rectification of any defects in the work of construction, reconstruction or repair under this article.
