The Supervisors of the Township of Montgomery, County of Montgomery and Commonwealth of Pennsylvania, hereby signify their intention to organize a Municipal Sewer Authority under the Municipality Authorities Act of 1945, as amended.[1]

The Supervisors of the Township of Montgomery are hereby authorized and directed to execute on behalf of said Township Articles of Incorporation for such an Authority in substantially the following form:
ARTICLES OF INCORPORATION
TO THE SECRETARY OF THE COMMONWEALTH
COMMONWEALTH OF PENNSYLVANIA
  In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended, the Supervisors of the Township of Montgomery, Montgomery County, Pennsylvania, desiring to incorporate an Authority thereunder, do hereby certify:
  1. The name of the Authority is the Montgomery Township Municipal Sewer Authority.
  2. The Authority is formed under the provisions of the Municipality Authorities Act of 1945, as amended.
  3. No other Authority organized under the Municipality Authorities Act of 1945, as amended, or under the Act of June 28, 1935, P.L. 463, as amended, is in existence in and for the incorporating municipality except the Montgomery Township Authority.
  4. The name of the incorporating municipality is the Township of Montgomery, Montgomery County, Pennsylvania.
  5. The names and addresses of the Supervisors of the Township of Montgomery, constituting its municipal authorities, are as follows:

The Secretary of the Supervisors of the Township of Montgomery is hereby directed to cause a notice of this article to be published as required by Section 3 of the Municipality Authorities Act of 1945, as amended.[1]

The proper officers of the Township are hereby directed to file the above Articles of Incorporation, together with the necessary proofs of publication, with the Secretary of the Commonwealth and to do all other acts and things necessary or appropriate to effect the incorporation of the Montgomery Township Municipal Sewer Authority.
The initial project shall be the acquiring, holding, constructing, improving, maintaining and operating, owning and leasing, either in the capacity of lessor or lessee, sewers, sewer systems or parts thereof, sewage treatment works and related facilities, including the provision of sewage treatment facilities in cooperation with the Township of Hatfield and any municipal authority heretofore organized by said Township.
The persons named and the terms of office set forth in the Sixth Article of the Articles of Incorporation, the execution of which is authorized and directed by § 46-2 hereof, are hereby appointed as the first members of the Board of the Authority, and their terms of office shall commence on the date of appointment and shall be computed from January 1, 1964.

For the purpose of constructing, extending, installing, maintaining, safeguarding or repairing its sewer facilities, the Montgomery Township Municipal Sewer Authority is authorized to enter in, under and upon any and all streets or other ways now or hereafter in public use within this Township; subject, however, to the following conditions:
A. 
The Authority shall cause as little inconvenience to the public in the use of such streets and ways as may be reasonably possible and shall comply with the reasonable requirements of the Board of Township Supervisors in such regard.
B. 
Upon completion of any work the Authority shall restore such streets and ways as nearly as may be possible to the conditions prevailing before the work began.
C. 
The Authority shall indemnify the Township and its Board of Supervisors against all loss and expense by reason of injury to persons or damage to property resulting from operations of the Authority in such streets and ways or the maintenance of its facilities thereunder and, upon request of the Board of Township Supervisors, shall obtain insurance in reasonable amounts covering such risks.
The aforesaid Authority is hereby granted the right and easement to construct and maintain its sewer facilities under any and all streets or other ways now or hereafter in public use within this Township.
