Promotions shall be based on merits ascertained by examinations to be prescribed by the Commission. All questions relative to promotions shall be practical in character and such as will fairly test the merit and fitness of persons seeking promotion. All changes from a lower to a higher position or rank shall be considered as promotions, but lateral moves to an equivalent position shall not be considered a promotion. Borough Council shall have the power to determine in each instance whether an increase in salary shall constitute a promotion. Unless otherwise determined by the Borough:
A. 
No increase in salary without change to higher position or rank shall constitute a promotion.
B. 
Any change to a position or rank carrying an increase in salary shall constitute a promotion. All promotions shall be made only in accordance with these rules and regulations.
The lines of promotion shall be as indicated below:
A. 
Sergeant.
B. 
Patrolman Class 1.
C. 
Patrolman Class 2.
D. 
Patrolman Class 3.
E. 
Patrolman Class 4.
F. 
Patrolman Class 5.
G. 
Patrolman Class 6.
Promotions to positions shall be based upon knowledge of local geography, Borough ordinances and municipal administrative organizations; the Motor Vehicle Code and other statutes and regulations having general and frequent application in the Borough; criminal law and investigation; familiarity with police duties, liabilities, responsibilities and procedures; and upon the ability to exercise judgment and discretion in situations involving the exercise of police power, as well as comply with all requirements as stipulated in all Police Department orders, duties and responsibilities and policies and procedures. Promotion will require approval of the Chief of Police, in a form known as a "Chief's Certification," which is based upon satisfactory attainment of the above.
A. 
Every Class 6 Patrolman, after serving for a period of six months, including any time spent at any training school, shall be promoted to the position of Class 5 Patrolman, provided that:
(1) 
He shall have completed such courses of instruction and training, as prescribed by the Chief of Police, in accordance with the Mandatory Police Training Act of 1974[1] and shall have passed with a grade of 70% or better all examinations with respect to such courses.

(2) 
He shall be physically fit, and if, in the judgment of the Chief of Police, a medical reexamination or psychological examination is required, the officer shall undergo a physical examination by a medical examiner and/or psychologist designated by the Borough.
(3) 
He shall have received satisfactory evaluation reports from the Chief of Police, and his record, with respect to his personal conduct and performance of his duties as a probationary patrolman, had been satisfactory to the Chief of Police.
B. 
If any Class 6 Patrolman probationary shall not qualify for promotion due to his failure to comply with this section, he shall cease to be a member of the police force and shall be entitled to no further compensation, except when his failure to pass a satisfactory physical examination is due to injuries received in the line of duty, in which event, at the discretion of the Borough, he may be continued as a Class 6 Patrolman probationary and shall thereafter be assigned to such duties as the Chief of Police may direct.
A. 
Every Class 5 Patrolman, after serving as such for a period of six months, shall be promoted to the position of Class 4 Patrolman, provided that:
(1) 
He shall have received satisfactory evaluation reports from the Chief of Police, and his record, with respect to his personal conduct and performance of his duties as a probationary patrolman, had been satisfactory to the Chief of Police.
(2) 
He shall be physically fit, and, if in the judgment of the Chief of Police, a medical reexamination or psychological examination is required, the officer shall undergo examinations by a medical examiner and/or psychologist designated by the Borough.
(3) 
He shall take and pass all courses of instruction and training, as prescribed by the Chief of Police, and shall pass all tests with a grade of 70% or better on all examinations.
B. 
Failure to qualify for promotion.
(1) 
If any Class 5 Patrolman probationary shall not qualify for promotion due to failure to comply with Subsection A(1) of this section, he shall immediately cease to be a member of the police force and shall be entitled to no further compensation.
(2) 
If any Class 5 Patrolman probationary shall not qualify for promotion due to his failure to pass a physical or psychological examination, he shall immediately cease to be a member of the police force and shall be entitled to no further compensation, except when his failure to pass a satisfactory physical examination is due to injuries received in the line of duty, in which event, at the discretion of the Borough, he may be continued as a Class 5 Probationary patrolman, or reduced to such a position as the Borough may designate, and he shall be assigned to such duties as the Chief of Police shall direct.
(3) 
If any Class 5 Patrolman shall not qualify for promotion due to his failure to pass the courses of instruction and training prescribed by the Chief of Police, he shall be discharged from police service prior to the end of the one-year probation period.
A. 
Every Class 4 Patrolman, after serving six months, shall be promoted to the position of Class 3 Patrolman, provided that:
(1) 
He shall have received satisfactory evaluation reports from the Chief of Police, and his record, with respect to his personal conduct and performance of his duties as a probationary patrolman, have been satisfactory to the Chief of Police.
(2) 
He shall take and pass all courses of instruction and training as prescribed by the Chief of Police and shall pass all tests with a grade of 70% or better on all examinations.
B. 
If any Class 4 Patrolman shall not qualify for promotion due to failure in accordance with Subsection A(1) and (2) of this section, he shall be retained as a Class 4 Patrolman for six more months, and then will be given the opportunity to retake any tests which he failed and the opportunity to be reevaluated and upgrade such evaluation report. In the event that he fails the second time, the procedure will be repeated; in other words, he will be given six more months to upgrade his evaluation report.
C. 
No Class 4 Patrolman will be promoted until he passes all tests and examinations with a grade of 70% and a satisfactory evaluation report.
A. 
Every Class 3 Patrolman, after serving as such for a period of six months, shall be promoted to the position of Class 2 Patrolman, provided that:
(1) 
He shall have received satisfactory evaluation reports from the Chief of Police, and his record, with respect to his personal conduct and performance of his duties as patrolman, have been satisfactory to the Chief of Police.
(2) 
He shall take and pass all courses of instruction and training as prescribed by the Chief of Police and shall pass all tests with a grade of 70% or better on all examinations.
B. 
If any Class 3 Patrolman shall not qualify for the promotion due to failure in accordance with Subsection A(1) and (2) of this section, he shall be retained as a Class 3 Patrolman for six more months and will be given the opportunity to retake any tests which he failed and the opportunity to be reevaluated and upgrade such evaluation report. In the event that he fails the second time, the process will be repeated; in other words, he will be given six more months to upgrade his evaluation report and pass such tests that he failed.

He shall have received satisfactory evaluation reports from the Chief of Police, and his record, with respect to his personal conduct and performance of his duties as a patrolman, have been satisfactory to the Chief of Police.
(2) 
He shall take and pass all courses of instruction and training as prescribed by the Chief of Police and shall pass all tests with a grade of 70% or better on all examinations.
B. 
If any Class 2 Patrolman shall not qualify for the promotion due to failure in accordance with Subsection A(1) and (2) of this section, he shall be retained as a Class 2 Patrolman for six more months and will be given the opportunity to retake any tests which he failed and the opportunity to be reevaluated and upgrade such evaluation report. In the event that he fails the second time, the process will be repeated; in other words, he will be given six more months to upgrade his evaluation report and pass such tests he has failed
C. 
No Class 2 Patrolman will be promoted until he passes all tests and examinations with a grade of 70% and a satisfactory evaluation.

Promotions to positions or ranks above that of Class 1 Patrolman may be extended either to members of the Aldan Police Department or to additional candidates who fulfill the experience requirements and qualify based upon competitive examination.
A.

B. 
For all other promotions or for such promotions requiring special scientific, professional, technical, clerical, electronic or mechanical skills, the Commission shall specify qualifications for positions.
A. 
Promotions shall be based on merits to be ascertained by examinations to be prescribed by the Commission. Borough Council shall notify the Commission of any vacancy in the police force above the position of police officer which Borough Council elects to fill and shall request certification of a list of eligibles.
B. 
To establish an eligibility list, the Commission shall notify all eligible members of the police force of the time and place of examinations for promotion, shall examine all applicants and shall establish a list of eligibles from which certification for promotion shall be made as above provided. Such notice of examination shall be given by letter, sent by registered mail, to each eligible member of the police force at his address on file in the Police Department. The Commission will also advertise for outside applicants to be certified as eligibles.
C. 
Promotional examination elements.

(2) 
Applicants will be required to further demonstrate ability to meet all of the eligibility requirements as specified in Article III. The Commission may require psychological physical examination, polygraph tests or other examinations.
D. 
The Commission shall thereupon certify to Borough Council for promotion from the eligible list, for each vacancy which is to be so filled, the names of the three persons thereon who have received the highest score. If there are not three names on the eligible list, the Commission shall certify the names or name remaining on the list. The Commission shall post in its office the eligible list containing the names and scores of those who have been certified as eligible, which list shall be effective only until new examinations are held, but not exceed two years.
E. 
Borough Council, with sole reference to the merits and fitness of the candidates, shall make promotion from the names or name certified in order of certification. When a promotion is made from the names certified, the names of the eligibles not promoted, unless stricken off for cause, shall be returned to the eligible list; provided, however, that no name shall be certified more than two times without reexamination.
All promotional appointments to the police force shall be for a probationary period of one year, but during the probationary period, an appointee may be dismissed only for a cause specified in § 6-60 of these rules and regulations. If, at the close of the probationary period, the conduct or fitness of the probationer has not been satisfactory to Borough Council for any reason, the probationer shall be notified in writing by the Borough Secretary that he will not receive a permanent appointment, and, thereupon, his appointment shall cease. Otherwise, his retention shall constitute a permanent appointment.
