The following words and phrases, as used in
this chapter, shall have the meanings hereby ascribed thereto unless
the context clearly indicates a different meaning:
BUILDING LINE
A line parallel to the front, side or rear lot line set so
as to provide the required yard.
COMMISSION
The Planning Commission of the Borough of Milton.
DWELLING UNIT
One or more rooms used for living and sleeping purposes and
having a kitchen with fixed cooking facilities arranged for occupancy
by one family.
ENGINEER
The Borough Engineer of Milton, being a registered engineer
authorized to practice civil engineering as defined by the Registration
Act of the Commonwealth of Pennsylvania.
ENGINEERING SPECIFICATIONS
The engineering specifications of the borough regulating
the installation of any required improvements or for any facility,
installed by an owner, subject to public use.
FLOODPLAIN
A relatively flat or low land area adjoining a river, stream
or watercourse, which is subject to partial or complete inundation
by floodwaters of the one-hundred-year frequency as shown on the Official
Milton Borough Zoning Map.
LAND DEVELOPMENT
Any of the following activities:
A.
The improvement of one lot or two or more contiguous
lots, tracts or parcels of land for any purpose involving:
(1)
A group of two or more residential or nonresidential
buildings, whether proposed initially or cumulatively, or a single
nonresidential building on a lot or lots regardless of the number
of occupants or tenure; or
(2)
The division or allocation of land or space,
whether initially or cumulatively, between or among two or more existing
or prospective occupants by means of or for the purpose of streets,
common areas, leaseholds, condominiums, building groups or other features.
C.
Development in accordance with Section 503,
Subdivision (1.1), of the Pennsylvania Municipalities Planning Code, Act of 1968, P.L. 805, No. 247, as amended by the Act
of December 21, 1988, P.L. 1329, No. 170, which excludes from land
development:
(1)
The conversion of an existing single-family
detached dwelling or single-family semidetached dwelling into not
more than three residential units, unless such units are intended
to be a condominium;
(2)
The addition of an accessory building, including
farm buildings, on a lot or lot subordinate to the existing principal
building; or
(3)
The addition or conversion of buildings or rights
within the confines of an enterprise which would be considered an
amusement park.
LOT
A plot or parcel of land which is or in the future may be
offered for sale, conveyance, transfer or improvement.
PERSON
Any individual or group of individuals, partnership, copartnership
or corporation.
SANITARY SEWER
A pipe for conveying sewage and excludes storm-, surface
and ground water.
STORM SEWER
A pipe for conveying rainwater, surface water, condensate,
cooling water and similar liquid waste, exclusive of sewage or industrial
waste.
STREETS
Public rights-of-way for vehicular or other traffic, whether
designated as streets, highways, thoroughfares, parkways, throughways,
roads, avenues, boulevards, lanes, places, alleys or however other
designated, and for the purpose of this chapter classed as follows:
A.
PRIMARY STREETSStreets which transverse through the municipality and are used primarily for through, fast or heavy traffic.
B.
SECONDARY AND COLLECTOR STREETSStreets which carry traffic from minor streets to the major system of primary streets, including principal entrance streets of a residential development and streets for major circulation within such developments.
C.
MINOR STREETSStreets which are used primarily for access to the abutting properties.
D.
MARGINAL ACCESS STREETSMinor streets which are parallel to and adjacent to primary streets and which provide access to abutting properties and protection from through traffic.
E.
ALLEYSMinor ways which are used primarily for vehicular service access to the back or the side of properties otherwise abutting on a street.
STREET WIDTH
The shortest distance between the lines delineating the right-of-way
of a street.
SUBDIVIDER
The owner or authorized agent of the owner of a lot, tract
or parcel of land to be subdivided and/or developed under this chapter.
SUBDIVISION
The division of a single lot, tract or parcel of land, or
part thereof, into two or more lots, tracts or parcels of land, including
changes in street lines or lot lines, for the purpose, whether immediate
or future, of transfer of ownership or of building development; provided,
however, that divisions of land for agricultural purposes in parcels
of more than 10 acres, not involving any new street or easement of
access, shall not be included within the meaning of "subdivision."
The term includes resubdivision and, when appropriate to the context,
shall relate to the process of subdividing or to the land subdivided
and/or developed.
SURVEYOR
A registered surveyor, as defined by the Registration Act
of the Commonwealth of Pennsylvania.
