The owner or occupant of lands fronting or abutting on any street, avenue, highway, traveled road, public lane, alley or square shall maintain the grass, weeds, brush, hedges and trees so as to prevent obstruction or interference with the free use of the sidewalk extending from the property line to the curbline, and such owner or occupant shall repair cracks, heaves and other defects in the sidewalk between the border of the sidewalk furthest from the street (hereinafter the "property line") and the curbline.
By written notice, the Board of Trustees, its designated representative, or the Village Building Inspector may require the owner or occupant of land fronting or abutting on any street, avenue, highway, traveled road, public lane, alley or square to maintain or repair the sidewalk between the property line and the curbline. The written notice shall specify the place, manner and a reasonable time period, under the circumstances, within which the maintenance and/or repair shall be completed.
If the owner or occupant fails to maintain and/or repair the sidewalk within the time provided in the notice provided pursuant to § 160-25, the Board of Trustees, its designated representative, or the Village Building Inspector may cause the sidewalk to be maintained or repaired, and costs of maintenance and/or repair shall be imposed and collected against the fronting or abutting property in the same manner as provided by the Code for the collection of delinquent Village taxes.
The requirements of this article shall be in addition to the requirements set forth in Articles I through VI of this chapter.
Any person violating any provision of this article shall be guilty of a violation punishable by a fine not exceeding $250 for each offense or by imprisonment not exceeding 15 days, or both.
The owner or occupant of lands fronting or abutting on any street, highway, traveled road, public lane, alley or square shall be liable for any injury or damage caused by reason of omission, failure or negligence in maintaining or repairing such sidewalk. Liability under this section shall apply with equal force and effect to any injury or damage caused by reason of omission, negligence or failure of an owner or occupant to comply with Articles I through VII of this chapter.
