This Part shall be commonly known as the "Special Snow Condition Ordinance of the Town of Bloomsburg." The purpose of this Part is to provide for an effective and efficient system of plowing and removal of snow from the streets, highways and parking lots of the Town of Bloomsburg.

The Mayor of the Town of Bloomsburg or the Chief of Police, or the officer in charge as his/her designee, is hereby authorized to declare a special snow condition to exist when any of the streets, highways or parking lots, or parts thereof, are covered by snow or ice, which, in his/her discretion, causes or will cause a condition of serious traffic congestion or undue difficulty in parking.

A. 
The declaration of a special snow condition and the substance thereof shall be announced by means of local radio broadcast within the Town of Bloomsburg and local newspaper publication within the Town of Bloomsburg, to the extent practical.
B. 
Appropriate signs shall be placed in all parking lots owned or under the control of the Town of Bloomsburg that are readily observable in such parking lots notifying the public of its duty to remove motor vehicles from such parking lots when a special snow condition is declared and advising the public that failure to remove such motor vehicles from such parking lots may result in the issuance of a citation and the towing of such motor vehicle at the owners expense. The sign shall read as follows:
Upon the declaration of a Special Snow Condition, all motor vehicles shall be removed from this parking lot. Failure to do so shall result in ticketing and towing of the motor vehicle.
C. 
The owner of a motor vehicle that is parked in a parking lot owned or controlled by the Town of Bloomsburg for a period of time in excess of 12 hours before snow removal commences shall be presumed to have knowledge of the declaration of a special snow condition for purposes of this Part.

It shall be unlawful for any person to park, permit to be parked, or permit to remain to be parked, any motor vehicles on streets, highways or parking lots where parking is prohibited in accordance with a declared special snow condition.

Any person who parks, permits to be parked, or permits to remain to be parked, any vehicle in violation of a declared special snow condition shall be guilty of a violation of this Part. Each such person shall pay at the office of the Chief of Police the sum of $50 within 20 days of the date of the violation. If the sum of $50 is not paid within 20 days of the date of the violation, a citation shall be filed in the Office of the Magisterial District Court, and upon conviction, the violator shall be sentenced to pay a fine of $60 plus costs of prosecution, or in default of payment, to imprisonment for one day for each $10 of the unpaid balance.

In order to facilitate the removal of accumulated snow and ice from streets, highways or parking lots where parking is prohibited in accordance with a declared special snow condition, the Police Department of the Town of Bloomsburg is hereby authorized to remove and impound motor vehicles as provided for at Chapter 15, Part 9, §§ 901 through 907, of the Code of Ordinances of the Town of Bloomsburg.

An owner of a motor vehicle who asserts that his or her motor vehicle was improperly towed because of lack of notice may appeal to the Town Administrator by filing an appeal, in writing, within five days from the date of towing. An informal hearing shall be held before the Public Safety Committee of the Town of Bloomsburg.
