[HISTORY: Adopted by the Mayor and Council of the Borough of Clayton 5-14-1987 by Ord. No. 87-6. Amendments noted where applicable.]
Pursuant to N.J.S.A. 40A:9-135, there is hereby created the office of Deputy Borough Clerk of the Borough of Clayton, to be appointed by the Mayor with the advice and consent of Council. The term of said Deputy Borough Clerk shall run from January 1 until December 31 of each year.
The duties of the Deputy Borough Clerk shall be to aid and assist the Borough Clerk under the direction and supervision of the Borough Clerk and to do and perform such functions and duties as may be assigned by the Borough Clerk and to have all the powers and perform all the functions and duties of the Borough Clerk for such times and for such periods as the Borough Clerk shall be absent or otherwise unable to perform.
The Deputy Borough Clerk shall, in the absence of the Borough Clerk or if the Borough Clerk is otherwise unable to perform, have the right and power to execute all documents required by law or ordinance to be executed by the Borough Clerk and affix the Seal of the Borough thereto whenever required. In signing any documents, the Deputy Borough Clerk shall sign the name of the Borough Clerk followed by the word "By" and the Deputy Borough Clerk's own name and the words "Deputy Borough Clerk."
Before entering office, the Deputy Borough Clerk shall execute a bond in such amount as provided by law, conditioned upon the faithful performance of his or her duties.
The salary of the Deputy Borough Clerk shall be such as shall from time to time be fixed by the Salary Ordinance of the Borough of Clayton.[1]
