All landowners, developers, consultants, or contractors who
desire to connect a dwelling to the Lower Heidelberg Township's
Sewer System shall comply with technical specifications for the construction
of sanitary sewers and appurtenances (technical specifications).

The technical specifications shall be adopted by the Township
Board of Supervisors by resolution, which may be amended from time
to time.

The technical specifications shall be made available by the
Township to all landowners, developers, consultants, and contractors
who desire to connect a dwelling to the Lower Heidelberg Township's
sewer system.

All extensions and connections shall also comply with the most
recent version of the Commonwealth of Pennsylvania Department of Environmental
Protection regulations, including the "Domestic Wastewater Facilities
Manual, as amended or revised.

Any provision of any prior ordinance which may be in conflict
with this Part is hereby repealed insofar as a conflict may exist.

(a) This Part may be enforced in a manner consistent with the Second
Class Township Code.
(b) In addition to, or in lieu of, a civil enforcement action, the Township
may enforce this Part in law or equity, including but not limited
to performing and or completing unsatisfactory or incomplete work
on its own at the expense of the landowner, securing declaratory or
injunctive relief from the Court of Common Pleas, or the issuance
of a cease and desist order. The landowner, landowners, developers,
consultants, and contractor shall reimburse the Township for all court
costs and reasonable attorney fees incurred by the Township in all
legal proceedings at law or equity required to enforce this Part.
If any sentence, clause, section, or part of this Part is for
any reason found to be unconstitutional, illegal or invalid, such
unconstitutionality, illegality or invalidity shall not affect or
impair any of the remaining provisions, sentences, clauses, sections
or parts of this Part. It is hereby declared as the intent of the
Board of Supervisors of Lower Heidelberg Township that this Part would
have been adopted had such unconstitutional, illegal or invalid sentence,
clause section or part thereof not been included herein.
This Part shall take effect five days after its adoption.
