The Division of Administrative Services shall be responsible, under the direction and supervision of the Mayor, for the following:
A. 
Assist in the preparation of the budget;
B. 
Administer a centralized purchasing system;
C. 
Develop and administer a sound personnel system;
D. 
Oversee insurance defense and claims;
E. 
Be responsible for all municipal information technology;
F. 
Such other duties as may be prescribed by the Municipal Council.
The Division of Administrative Services shall be responsible for the preparation of forms for budget requests to be used by all departments and spending agencies; review and analyze all budget requests; establish procedures for all departments to maintain records and produce reports of the respective work load and performance for use in budget review and analysis; and to prepare appropriate reports and recommendations for the Business Administrator to assist the Mayor or in the preparation of the budget.
The Division of Administrative Services shall develop and enforce a centralized purchasing system and uniform procedures for all departments and shall supervise the bidding, negotiation and award of contracts (except contracts for public works and capital improvements), the receipt and inspection of all deliveries or purchased items or services, and authorize contract payments to be made by the Department of Finance.
A. 
The Borough Administrator shall be responsible for the development and administration of a sound personnel system for all departments, offices and agencies of the Borough. Such system shall be subject to review and approval of the Mayor and Council in the manner set forth herein.
B. 
The Mayor and Council of the Borough of Hawthorne shall by ordinance establish titles for pubic employment by the Borough and salary ranges for Borough employees. (Said titles shall conform to the New Jersey Civil Service Act and regulations promulgated by the New Jersey State Department of Personnel.)
C. 
The Mayor and Council of the Borough of Hawthorne shall by resolution adopt and amend from time to time personnel policies and procedures, including rules concerning the hiring and termination of employees, terms and conditions of employment, and regulations required to comply with applicable federal and state employment-related law. The personnel policies and procedures adopted pursuant to said resolution shall be applicable to all officials, appointees, employees, prospective employees, volunteers and independent contractors of the Borough.
D. 
The Borough Administrator shall be responsible to implement and enforce the personnel practices adopted by ordinance or resolution authorized pursuant to this section. If there is a conflict between said personnel practices and any duly adopted and lawful collective bargaining agreement, personal services contract or federal or state law, the terms and conditions of that contract or law shall prevail. In all other cases, the practices adopted pursuant to this section shall prevail.
The Division of Administrative Services shall be responsible for the development and administration of a sound system of insurance and loss control for all departments, agencies and offices of the Borough, including:
A. 
Review of alternative insurance policies and programs available for worker's compensation, property, liability and employee health benefits, making recommendation to the Mayor and Council as to those policies or plans best meeting the needs of the Borough.
B. 
Establishment of procedures to ensure that all claims, losses and accidents are properly investigated and processed.
C. 
Review of accident and loss histories and other information regarding identified risk exposure in order to establish policies so as to minimize such exposure.
The Division of Administrative Services shall be responsible for the coordination of information technology utilized by all departments, divisions and agencies of the Borough, including the establishment of standards for software, hardware, wiring and internet access and to create and promulgate rules regarding the same so as to ensure compliance with applicable regulations, security parameters and, where necessary, interdepartmental compatibility.

A. 
Purpose. Pursuant to Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.), the Legislature of the State of New Jersey has created a Defined Contribution Retirement Program to provide retirement benefits to various county and municipal officials. Each municipality is required thereunder to identify those positions which, in accordance with applicable guidelines, are eligible for and shall participate in the Defined Contribution Retirement Program, subject to the provisions of law.
B. 
Positions eligible for participation in the Defined Contribution Retirement Program.
(1) 
Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
(a) 
Borough Administrator.
(b) 
Director of Finance (except that any portion of salary paid for duties as Chief Financial Officer, Tax Collector or other duties exempt under Subsection B(3) of this section shall be included as Public Employees Retirement Service compensation and exempt from Defined Contribution Retirement Program.
(c) 
Director of Public Works (if not serving as Principal Public Works Manager by virtue of appointment as Director).
(d) 
Borough Attorney.
(e) 
Borough Engineer (if a salaried position).
(f) 
Municipal Prosecutor.
(g) 
Municipal Court Judge.
(h) 
Planning Board Attorney/Secretary.
(i) 
Zoning Board Attorney/Secretary.
(j) 
Chief of the Fire Department.
(2) 
Any individual serving in one of the titles listed in Subsection B(1) of this section who, having been enrolled in the Public Employees Retirement System prior to July 1, 2007, is eligible to continue as a member of the Public Employees Retirement System pursuant to the provisions of Chapter 92, P.L. 2007, of the State of New Jersey, shall continue to participate in the Public Employees Retirement System rather than the Defined Contribution Retirement System.
(3) 
Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
(a) 
Tax Collector.
(b) 
Chief Financial Officer.
(c) 
Construction Code Official.
(d) 
Qualified Purchasing Agent.
(e) 
Tax Assessor.
(f) 
Registered Municipal Clerk.
(g) 
Licensed Uniform Subcode Inspector.
(h) 
Principal Public Works Manager.
C. 
This section shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
D. 
A copy of this section shall be filed with the Director of the Division of Pensions and Benefits of the New Jersey Department of the Treasury.
