The unrestricted and unregulated erection and maintenance of advertising devices visible from the highway system within the Town will create conditions which are inimical to the public interest, interfere with the safety, comfort, security and welfare of the people of this Town and mar the natural beauty of the area. In order to prevent such conditions, the Town Board hereby determines that the following enactment is necessary.
The erection or maintenance of any advertising device on land within the Town of Austerlitz, which advertising device exceeds 25 square feet in area, and which advertising device is visible from any highway within the Town of Austerlitz, is prohibited.
As used in this chapter, the following terms shall have the meanings indicated:
- ADVERTISING DEVICE
- Includes any billboard, sign, notice, poster, display or other device intended to attract or which does attract the attention of operators of motor vehicles on any highway within the Town and shall include a structure erected or used in connection with the display of any such device and all lighting or other attachments used in conjunction therewith.
Nothing in this chapter shall apply with respect to any property which is owned or leased by the State of New York, and nothing herein shall apply with regard to any directional or other official signs or signals erected or maintained by the state or other public agency having jurisdiction.
Each violation of the provisions of this chapter shall be deemed a violation and punishable by a fine not to exceed $100 and/or imprisonment not exceeding 15 days. In addition, the Town Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or to restrain, by injunction, the violation of any of the provisions of this chapter.
