For the purpose of this article, the following term(s) shall
have the meanings ascribed to them as follows:
DERELICT VEHICLE
Any inoperable, unregistered or discarded motor vehicle,
regardless of title, having lost its characteristic as a substantial
property and left unattended without justification on the owner's,
lienholder's or other legally entitled person's land contrary to the
public policy expressed in this article. "Derelict vehicle" shall
include, but not be limited to, any automobile, truck or trailer or
automobile, truck or trailer parts, such as conex boxes, shipping
containers and cargo boxes which have been modified for use as storage
units.
INOPERABLE MOTOR VEHICLE
Any motor vehicle which, for a period of at least seven days,
the engine, wheels, body including truck and trailer beds, or other
parts have been removed, or on which the engine, wheels, body including
truck and trailer beds, or other parts have been altered, damaged
or otherwise so treated that the vehicle is incapable of being driven
under its own motor power. "Inoperable motor vehicle" shall not include
a motor vehicle which has been rendered temporarily incapable of being
driven under its own motor power in order to perform ordinary service
or repair operations. "Inoperable motor vehicle" shall include automobile,
truck and trailer parts being used as storage units.
All inoperable motor vehicles and derelict vehicles, whether
on public or private property in view of the general public, are hereby
declared to be nuisances.
The Mayor shall notify the owner of the motor vehicle, informing
him that he shall dispose of any inoperable or derelict vehicles under
his control. If the owner fails to dispose of said inoperable or derelict
vehicle(s) after seven days from the issuance of the notice, the Mayor
may authorize a towing service to remove and take possession of the
inoperable or derelict vehicle or parts thereof.
Nothing in this article shall apply to any motor vehicle that
is kept within a building when not in use, to operable historic vehicles
over 25 years of age, or to a motor vehicle on the premises of a licensed
business engaged in the wrecking or junking of motor vehicles. Vehicles
for sale, repair or stored for more than seven days, but less than
90 days may be kept off the road without current licensing with the
purchase of a temporary permit issued by the Village for a fee of
$30. Application for said permit will describe the vehicle, state
its VIN number and the reason for the vehicle being unlicensed. The
temporary permit is nonrenewable.
