No person having in his possession or under his control any animal or fowl shall allow the same to run at large within the Village.

A. 
No person shall keep or maintain any poultry (with the exception of chickens) or fowl, or any livestock such as horses, cattle, sheep or goats in any zoning district except agricultural districts. The keeping of chickens in an R-1 Single-Family Residential District shall be permitted subject to the regulations adopted by the Village of Fremont.
B. 
In addition to all other regulations in this chapter, the following shall apply to keeping of chickens within the Village.
(1) 
The property's principal use is a single-family dwelling.
(2) 
A maximum of four chickens may be kept per residence.

(3) 
No roosters shall be kept.
(4) 
Chickens shall be provided a shelter that must be a minimum of three square feet per chicken.
(5) 
Chickens must be provided a fenced-in place to run, and shall be a minimum of five square feet per chicken.
(6) 
All chicken coops and pen areas shall be set back a minimum of 10 feet from the side and rear property lines and a minimum of 25 feet from any adjacent principal residential structures.
(7) 
No slaughtering of chickens within the Village.
(8) 
Permit required. Any person who keeps chickens shall receive an annual permit from the Village Clerk for a fee of $25. The permit is valid from January 1 through December 31.
Any person who shall violate any provision of this article shall be subject to a penalty as provided in Chapter 1, General Provisions, Article I, Construction and Penalties, of this Code.
