A. 
No person, corporation, or representative of any firm shall place or permit to be placed any dumpster, oversized trash container or building materials on any public or private lands in the Borough of Swedesboro without first obtaining a permit to do so.
B. 
Said permit shall be issued by the Construction Code Official/code enforcer following the filing of an application indicating the exact location and purpose of placement.
C. 
Said application shall be submitted to the Chief of Police or his designee for review, and, after determining the safety and the appropriate nature of the location, said permit may be issued for a specific space for a period not to exceed seven days. Under certain conditions, a valid permit may be extended after a review by the Construction Code Official and/or code officer, and the Police Department.
As used in this article, the following terms shall have the meanings indicated:
OVERSIZED TRASH CONTAINER
A receptacle with a capacity greater than 12 cubic yards and/or when filled containing in excess of two tons.
A. 
Each dumpster shall prominently display the name, address and telephone number of the owner thereof.
B. 
Each dumpster shall have both the front and rear surfaces reflectorized for night safety in such a manner as to indicate the height and width of the same.
The applicant to whom a permit is granted shall keep the container or building material properly marked, and at all times said placement shall allow for safe passage of pedestrians and vehicles in and along the public way. The Borough shall not be responsible for any injury to persons or damage to property resulting from the negligence of the applicant or his or her agents or employees.
Any person violating any provision of this article shall, upon conviction thereof, be punished by a fine not to exceed $200 or by imprisonment not to exceed 30 days, or both.
Each application shall be accompanied by a fee as set forth in Chapter 140, Fees, in cash or a check made payable to the Borough of Swedesboro.

Enforcement of this article shall be carried out by the Construction Code Official, Code Enforcement Officer, Recycling Coordinator, collection agency, or a duly authorized member of the Police Department.
The provisions of this article are not intended to apply to containers or receptacles used for normal weekly garbage and recycling collection not to include bundled brush and papers which have been placed to the curb for collection.
