The following are specific standards for brew pubs and breweries:
A. 
Must have all necessary permits and/or licenses from the Pennsylvania Liquor Control Board or any successor agency.
B. 
Must establish proof to the satisfaction of the Borough or Borough Solicitor that brew pub owner has an ownership interest in the brewery that produces the malt or brewed beverages being consumed at the brew pub.
C. 
The brew pub or brewery shall make food available to each patron who is consuming alcohol on the licensed premises while that person is consuming alcohol. Food must, at a minimum, consist of potato chips, pretzels and similar foods. Food may be prepared by the brewery or by a third party. [40 Pa. Code § 3.93(c)(4)].
D. 
A brewery must have seating for at least 10 patrons, while a brew pub must have seating for at least 25 patrons.
