Wherever in this article the following terms are used, they shall have the meanings respectively ascribed to them in this section, unless otherwise expressly provided, or unless a different meaning is reasonably and clearly apparent from the language or context:
ATTENDANT
Any person employed, authorized or empowered by the city to supervise or otherwise attend to the use and operation of any municipal parking area.
MUNICIPAL PARKING AREA
Any land, premises or area, other than a public way, now, or hereafter owned or leased by the city, and designated by the city as a municipal parking area.
PARKING
The stopping, standing or leaving of a vehicle, within a municipal parking area, whether occupied or not, for any purpose and for any period whatsoever.
PARKING METER
Any mechanical device, not inconsistent with the provisions of this article, and placed or erected on any municipal parking area for the regulation of parking. Each parking meter installed shall indicate by proper legend the parking time established by this article and when operated shall at all times indicate the balance of legal parking time permitted and at the expiration of such period shall indicate illegal or overtime parking.
PARKING METER SPACE
Any space within a municipal parking area, adjacent to a parking meter which is duly designated for the parking of a single vehicle by painted lines or other markings adjacent to or adjoining each parking meter.
PARKING SPACE
Any space within a municipal parking area on which parking meters are not installed, and which is duly designated for the parking of a single vehicle by painted lines or other markings.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a street or highway, except devices propelled by human power or driven by animals and except vehicles the overall size of which, including the load thereof, shall exceed seven feet in width and 20 feet in length.

It shall be lawful to park vehicles upon municipal parking areas during the hours and upon the terms, conditions and provisions of this article.

The several municipal parking areas shall be numbered and known as follows:
(a) 
The area bounded on the east by North Pearl Street, on the south by Melville Street, on the west and north by other land of various owners, including the City of Pittsfield, shall be numbered and known as Municipal Parking Area No. 1.
(b) 
The area bounded on the south by East Street, on the west by Willis Street and on the north and east by other land of various owners shall be numbered and known as Municipal Parking Area No. 2.
(c) 
The area bounded on the east by First Street, on the south by land of various owners and Fenn Street, on the west by Pearl Street and other land of various owners, and on the north by Eagle Street shall be numbered and known as "Municipal Parking Area No. 3."
(d) 
The area bounded on the west by North Street (formerly the Showplace Theater), on the north, east, and south by other land of various owners, shall be numbered and known as "Municipal Parking Area No. 4."
(e) 
The area bounded on the east by McKay Street, on the south by other land of various owners, and on the north and west by Depot Street, including the McKay Center Parking Garage, shall be numbered and known as Municipal Parking Area No. 5.
(f) 
The area bounded on the north by Summer Street, on the east by other land of various owners, on the south by Columbus Avenue and on the west by other land of the City of Pittsfield, including the Columbus Avenue Parking Facility, shall be numbered and known as "Municipal Parking Area No. 7."
(g) 
The area bounded on the west by South Street (currently the Pittsfield Visitor's Center Parking Lot), on the north, east, and south by other land of various owners, shall be numbered and known as "Municipal Parking Area No. 6."
(h) 
The area bounded on the west by Seymour Street, on the north, east, and south by other land of various owners but within the block of land between Madison Avenue and Linden Street, shall be numbered and known as "Municipal Parking Area No. 8."
(i) 
The area bounded on the east by Seymour Street, on the south by Madison Avenue, on the north and west by other land of various owners, shall be numbered and known as "Municipal Parking Area No. 9."
(j) 
The area bounded on the west by Seymour Street, on the north, east, and south by other land of various owners but within the block of land between Madison Avenue and Kent Avenue, shall be numbered and known as "Municipal Parking Area No. 10."
(k) 
The area located south and west of the Airport Terminal Building built in 1968 (named the "West Parking Lot") owned and bounded by lands owned by the Pittsfield Municipal Airport Commission, shall be numbered and known as "Municipal Parking Area No. 11."
(l) 
The area located south and adjacent to the Airport Terminal Building built in 1968 (named the "South Parking Lot") owned and bounded by lands owned by the Pittsfield Municipal Airport Commission, shall be numbered and known as "Municipal Parking Area No. 12."

The parking of any vehicle on a municipal parking area under the terms and provisions of this article shall be under a temporary license, permit or privilege which shall be revocable at the will and option of the City. It shall not constitute or render the City or any of its officers, agents, servants or employees the bailee or custodian of such vehicle or any property therein.

By parking a vehicle on a municipal parking area, the owner and operator thereof shall assume all risk, responsibility and liability for any theft thereof or of property therein, and for any loss or damage thereto or to any property therein, caused by or resulting from any cause whatever, and the exercise of the license, permit or privilege of parking a vehicle on a municipal parking area under the terms and provisions of this article shall constitute and operate as a release and discharge of the City from any responsibility, obligation or liability for the theft thereof or of any property therein, and for any loss or damage thereto or to any property therein, caused by or resulting from any cause whatever.

Any person, including, but not limited to the owner, operator or occupant of any vehicle, going in, on, upon, over or across any municipal parking area, whether on foot or in a vehicle, for or in connection with any purpose authorized or permitted under this article, shall, by virtue of such act, assume all risk, responsibility and liability for injuries to his person, or for death, resulting from any cause whatsoever; and the exercise of the license, permit or privilege of being on such municipal parking area under the terms and provisions of this article shall constitute and operate as a release and discharge of the City from any responsibility, obligation or liability for any personal injuries, for death, or for any and all losses, claims or damages arising or resulting from or in consequence of such injuries or death.

No vehicle, except those vehicles of the City and vehicles of residents as permitted by the City under a temporary permit which shall be revocable at the will and option of the City, shall be parked on any municipal parking area during the hours from 12:00 a.m. to 7:00 a.m. daily. Every vehicle entering a municipal parking area, at any time, shall enter such parking area only for the purpose of parking, with the exception of emergencies, repairs and delivery vehicles. No vehicle while on any portion of any municipal parking area shall travel in excess of 10 miles per hour.

The number of hours that a vehicle may be parked upon the various municipal parking areas shall be reviewed by the Traffic Commission and approved by the City Council. A violation of this section shall be deemed to have occurred if a motor vehicle bearing a specific registration plate number is found to be parked in excess of the designated parking period, between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday, in the same parking space or a space within the same municipal parking area in which the vehicle was parked at the time the registration was recorded, except when the motor vehicle has a City-issued temporary parking permit allowing them to park in a free parking space.

The owner or operator of a vehicle parking the same within a parking meter space upon a municipal parking area shall immediately deposit in the parking meter for such space the required coin of the United States for the maximum legal parking period, or for any permitted subdivisions thereof, as indicated or shown on the meter; and if so required he shall set the mechanism in motion.

(a) 
The fee for the use of a parking meter space upon the various municipal parking areas shall be as determined by the Traffic Commission.
(b) 
Monthly parking rates, per space, effective July 1, 2010:
(1) 
McKay Street, Lot 5, overnight resident permit parking: $20.
(2) 
McKay Street, Lot 5A, permit parking (7:00 a.m. to 4:00 p.m.): $35.
(3) 
McKay Garage, rooftop, Lot 5B (7:00 a.m. to 4:00 p.m.): $25.
(4) 
McKay Garage, covered, Lot 5D (7:00 a.m. to 4:00 p.m.): $35.
(5) 
McKay Garage, covered, Lot 5C, reserved permit parking (7:00 a.m. to 4:00 p.m.): $70.

Sections 13-84 to 13-86 shall be applicable during such hours as shall be determined by the Traffic Commission.

After public hearings, the traffic commission shall adopt the regulations necessary for Sections 13-84 to 13-88. Said regulations shall take effect seven days after publication which shall be done as soon as possible by the traffic commission.

All municipal off-street parking areas shall have the specified number of reserved handicapped parking spaces as enumerated in Section 13-135. Said spaces shall have exactly the same size, shape, designation and location as required for private off-street parking areas in Section 13-136.

It shall be unlawful for any unauthorized person to tamper with, open, break, injure or destroy any parking meter upon a municipal parking area, or for any person to deposit or cause to be deposited in such meter any slug, device or metallic substance, or any other substitute for the coins required for the operation of such meter; or to do any other thing or act which will render such meter inoperative.

Vehicles parked upon municipal parking areas shall be parked within the limits of parking spaces or parking meter spaces. Backing into such parking spaces or parking meter spaces is hereby prohibited.

The ignition keys shall be removed and the hand brake or emergency brake shall be applied by the owner or operator of every vehicle parked upon a municipal parking area.

No pets or animals shall be left in or upon any vehicle parked upon a municipal parking area.

Officers of the police department of the city, under the direction of the chief of police, are hereby charged and entrusted with the duty of enforcing the provisions of this article.
