The owner, occupant or tenant of every property fronting upon or alongside of any of the streets in the Borough of Muncy is hereby required to remove refuse, debris, snow and ice from all of the sidewalks in front of or alongside of such property at times and in manner as follows:
A. 
Refuse and debris shall be swept or removed otherwise, as may be necessary, at least once each day, excepting Sundays, from sidewalks adjoining commercial and industrial premises. Neither refuse nor debris shall be swept onto adjoining street or alley areas, but the same shall be gathered and placed in public containers if available. If public containers are not available, it shall be gathered and placed in containers provided by the owner, occupant or tenant, and shall be disposed of thereafter by the owner, occupant or tenant.
B. 
Refuse and debris shall be swept, gathered and removed from sidewalks adjoining residential properties at such times as may be necessary for safe and convenient pedestrian use of sidewalks, and as may be necessary for maintenance of said sidewalks in a sanitary condition.
C. 
Snow and ice removal.

(1) 
All snow or ice falling or forming on sidewalks in areas zoned central business district or general commercial district shall be removed by 10:00 a.m. unless precipitation is still falling, then it shall be removed by 10:00 a.m. on the following day.
(2) 
All snow or ice falling or forming on sidewalks in all other areas within the Borough shall be removed within 24 hours after the snow or ice has ceased to fall or form. All sidewalks shall be cleaned to a width of not less than 24 inches, for the full length of an owner, occupant or tenant's property. No person shall throw any snow upon the streets or alleyways of the Borough. The Chief of Police shall have the option to extend the time limit for snow removal due to excess snow accumulations or weather conditions.
The owner of a property shall be responsible for conforming with the requirements of § 236-22 where a property is occupied by the owner or is unoccupied. A tenant or occupier of property, where such property is occupied by such tenant or occupier only, shall be responsible for conforming with the requirements of § 236-22. The owner of a property where the property is multiple-residence, multiple-commercial or multiple-industrial shall be responsible for conforming with the requirements of § 236-22.
In any case where the owner, occupant or tenant, as aforesaid, shall fail, neglect or refuse to comply with the pertinent provisions of § 236-22 of this article within the time limit prescribed therein, the Borough authorities may proceed immediately to clear all refuse, debris, snow and/or ice from the sidewalk of such delinquents, and to collect the expenses thereof, with any additional amount allowed by law, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 236-25 of this article.

An owner, occupant or tenant who shall fail to remove any snow, ice, refuse or debris from any sidewalk as required, shall, for the first offense, be issued a nuisance violation by the Borough with a fine of $10. Failure to pay the fine within 48 hours shall result in a non-traffic citation being filed before the Magisterial District Judge and, upon conviction, be sentenced to pay a fine of not more than $200, costs of prosecution and/or imprisonment for not more than 15 days and for second and subsequent offense, be sentenced by the Magisterial District Judge as set forth above. Every day that a violation of this article shall continue will constitute a separate offense.
No provision hereof shall be construed as establishing a standard of care insofar as the same may relate to the safety of sidewalks of the Borough for pedestrian use.
