The Town Board of the Town of Martinsburg, pursuant to the authority granted it under § 381, Subdivision 2, of the Executive Law of the State of New York, and §§ 10 and 20 of the Municipal Home Rule Law of the State of New York, hereby enacts as follows.
The Town Board of the Town of Martinsburg has found it difficult to obtain qualified individuals with the necessary and requisite skills to enforce the New York State Uniform Fire Prevention and Building Code. Further, the Town Board has found that many of the individuals who may possess the necessary qualifications may also have conflicts of interest because of their enforcement in the building trades. It is believed that enforcement of the New York State Uniform Fire Prevention and Building Code by the County of Lewis will provide more uniformity and impartiality in the enforcement of the code. It is the purpose of this chapter to opt out of Town enforcement of the New York State Uniform Fire Prevention and Building Code as of January 1, 1997.
The Town Board of the Town of Martinsburg hereby elects to cease administration and enforcement of the New York State Uniform Fire Prevention and Building Code as of January 1, 1997.
