[Adopted 12-20-2000 by Ord. No. 596 (Ch. 7, Part 1, of the 1995 Code of Ordinances)]
As used in this article, the following terms shall have the meanings indicated:
LIQUIFIED PETROLEUM GAS (LP GAS or LPG)
Any material with a vapor pressure not exceeding that allowed for commercial propane composed predominantly of the following hydrocarbons, either by themselves or as mixtures:
A. 
Propane.
B. 
Propylene.
C. 
Butane (normal butane or isobutane).
D. 
Butylenes, including isomers.
The owners of all buildings or property or person(s) occupying the premises within the Township which currently contain or house an LPG storage container(s) exceeding 30 gallons (115 liters) individual water capacity and where the combined storage container quantity exceeds 60 gallons (230 liters), regardless of the individual storage container size, shall be required to apply for and obtain an annual Township license for that LPG storage container(s).
A. 
New liquefied petroleum gas containers.
(1) 
A permit application for the license of a new LPG storage container shall comply with the provisions of Chapter 36 of the BOCA National Fire Prevention Code, 1996 Edition.
(2) 
A new LPG storage container shall require the site plan approval in accordance with the application and procedure provisions contained in Chapter 350, Zoning, as amended.
B. 
Existing liquefied petroleum gas containers. A permit application for the license of an existing LPG storage container shall comply with the provisions of Chapter 36 of the BOCA National Fire Prevention Code, 1996 Edition, as amended.
C. 
Liquefied petroleum gas exchange. A permit application for the license of an LPG storage container exchange station shall comply with the provisions of Chapter 36 of the BOCA National Fire Prevention Code, 1996 Edition, as amended.
The property owner or person occupying the premises shall file an application in the form of a LPG permit for the licensing of any existing or new LPG storage container. The application shall include all of the information required on the LPG permit application in addition to the following information:
A. 
A survey of the property showing the location of the LPG storage container(s).
B. 
The capacity of the LPG storage container(s).
C. 
Proof of insurance.
D. 
A certified inspection regarding the proper maintenance of the LPG storage container.
E. 
License application fee.
Each license issued shall be effective for one calendar year, measured from the date of issuance and a new permit must be obtained before the current permit expires. The fee of the LPG license shall be $25 and such fee may be amended, from time to time, by the Township Council in the form of a resolution.
This article shall take effect on the date of adoption.
It shall be unlawful to install, operate or maintain a LPG storage container contrary to or in conflict with the provisions and requirements of this article.
Upon determining that a building or property owner, or person occupying the premises has failed to comply with the regulations of this article, the Council of the Township of Hampton or the Code Enforcement Officer may pursue any of the following enforcement remedies:
A. 
The Code Enforcement Officer of the Township of Hampton may provide written notice to the owners, occupants and other persons operating or maintaining a LPG storage container(s) in accordance with these regulations of the violation and need to comply within a specified date.
B. 
In the event that such persons fail to comply with these regulations despite notices to do so, the Township Code Enforcement Officer may issue a written order directing the owners, occupants or others in possession operating or maintaining LPG storage containers in violation of this article to comply with the applicable requirements of this article.
C. 
In the event the property owners or occupants or possessors fail to take action in accordance with the notices and an order issued pursuant to this article, the Township Code Enforcement Officer may file a citation with the Magisterial District Judge. Each day that a violation continues beyond the specified compliance date shall constitute as a separate offense.
Any person who shall be found to have engaged in the prohibited unlawful conduct as set forth in §§ 148-2, 148-3 and 148-4 of this article or who shall fail to comply with any order to comply with these LPG storage container regulations shall, upon conviction, be sentenced to pay a fine of no more than $500 together with court costs.
