For the convenience of those persons and entities which utilize the services of off-duty firefighters of the Fire Department and to authorize the outside employment of City firefighters while off duty, the City hereby establishes a policy regarding the use of firefighters.
A. 
Full-time career members of the Fire Department shall be permitted to accept fire-related employment for private employers or school districts only during off-duty hours and at such time as will not interfere with the efficient performance of regularly scheduled duty or emergency duty for the City.
B. 
Any person or entity wishing to employ off-duty firefighters shall first obtain the approval of the Fire Chief, which approval shall be granted if, in the opinion of the Fire Chief, such employment would not be inconsistent with the efficient functioning and good reputation of the Fire Department, and would not unreasonably endanger or threaten the safety of the firefighter or firefighters who are to perform the work.
C. 
Volunteer members of the Fire Department shall be permitted to accept fire-related employment for private employers or school districts only during off-duty hours and at such time as will not interfere with the efficient operation of the Fire Department, subject to the annual compensation limits applicable to volunteer members of the Fire Department.
A. 
Any person or entity requesting the services of an off-duty firefighter in the Fire Department shall estimate the number of hours such firefighter's services are required, which estimate shall be approved in writing by the Fire Chief.
B. 
Said person or entity shall establish an escrow account with the Chief Financial Officer of the City by depositing an amount sufficient to cover the rates of compensation and administrative fees set forth in § 17-68 for the total estimated hours or days of service. A day of service is equal to approximately eight hours.
C. 
Prior to posting any request for services of off-duty firefighters, the Fire Chief or his designee shall verify that the balance in the escrow account of the person or entity requesting services is sufficient to cover the compensation and fees for the number of hours specified in the request for services. The Fire Chief shall not post a request for services from any person or entity unless all fees and compensation required in the manner described above have been deposited with the Chief Financial Officer. No firefighter shall provide any such services for more hours than are specified in the request for services.
D. 
In the event that funds in such an escrow account should become depleted, services of off-duty firefighters shall cease and requests for further or future services shall not be performed or posted until additional funds have been deposited in the escrow account in the manner prescribed above.
E. 
The person or entity requesting such services shall be responsible for ensuring that sufficient funds remain in the escrow account in order to avoid any interruption of services.
A. 
All requests to the City for services of off-duty firefighters in the Fire Department for a period of one week or longer shall be forwarded to the Fire Chief for posting at least 10 days before such services are required.
B. 
Any full-time career firefighter, when so employed by the City shall be treated as an employee of the City; provided, however, that wages earned for outside employment shall not be applied toward the pension benefits of the full-time career firefighters so employed, nor shall hours worked for outside employment be considered in any way compensable as overtime.
A. 
Rates of compensation for contracting the services of off-duty full-time career firefighters are established as follows:
(1) 
Rate of compensation for private employers: $75 per hour.

Rate of compensation for school districts: $40 per hour.
B. 
Rates of compensation for contracting the services of off-duty volunteer firefighters are established as follows:
(1) 
Rates of compensation for private employers: $320 per day.
(2) 
Rates of compensation for school districts: $320 per day.
C. 
An additional fee of $5 per hour for full-time career firefighters and a set sum of $40 per day for volunteer firefighters is hereby established to cover administrative costs, overhead and out-of-pocket expenses of the City.
