For the purpose of this article, the following words and phrases shall have the meanings assigned to them by this section:
COMBUSTIBLE MATERIAL
All material that may be burned, such as brush, branches, small trees, waste wood, and all other discarded wood products from which all metal hardware and/or nails have been removed.
COMPOST MATERIAL
Only leaves and grass clippings.
EXCLUDED WASTE
All tires and all hazardous wastes as may from time to time be identified and listed by the Department of Natural Resources pursuant to § 291.05(2), Wis. Stats., and § NR 661.04(2)(a), Wis. Adm. Code.
GARBAGE
All household waste, except as identified below.
NONRECYCLABLE MATERIAL
Window glass, light bulbs and tubes, television tubes, used oil filters and ceramics.
OPERATOR
The party or entity operating a waste disposal site designated by the Town Board for use by residents of the Town.
RECYCLABLE MATERIAL
All newspaper, magazines, catalogs, scrap paper, cardboard, aluminum cans, tin cans, glass bottles, glass jars, plastic jugs, plastic bottles, used motor oil, and heavy metal.
RUBBISH
Nonrecyclable material and all other waste material not herein described, except construction waste materials (e.g., stone, dirt, roofing, concrete).
Commencing the day following publication of this article, anyone using the waste transfer site shall be required to separate recyclable material and combustible material from garbage and compost materials.
A. 
All recyclable material, combustible material, compost material, garbage and rubbish shall be disposed of at the waste transfer site only in the specific container or area which is designated as the depository for that type, color or composition of material.
(1) 
Newspapers, magazines and catalogs, and scrap paper shall each be separated.
(2) 
Cardboard shall be flattened.
(3) 
Aluminum cans shall be rinsed and stripped of labels.
(4) 
Tin cans shall be rinsed and stripped of labels.
(5) 
Glass bottles and jars shall be rinsed, stripped of tops, and separated by color (brown, green, clear).
(6) 
Plastic jugs and bottles shall be rinsed and tops removed.
(7) 
Motor oil may be deposited only at the waste transfer site located on Highway 51/16, one mile south of Portage.
(8) 
All garbage shall be placed in clear plastic bags not exceeding 30 gallons in capacity or 50 pounds in weight.
B. 
The operator shall refuse to accept excluded waste and any recyclable material which is not prepared in accordance with the requirements of this article and shall refuse to accept any construction waste or materials.
C. 
No person shall deposit any waste at the waste transfer site anytime that the site is closed.
D. 
No person shall dump, dispose, deposit or litter upon any street, alley, driveway, park or private property owned by others any excluded waste, recyclable material, garbage, combustible or compost rubbish, rubbish or construction waste or material; provided, however, nothing herein shall prevent any person from burning combustible materials if otherwise allowed or maintaining a private compost pile.
Any person that violates this article may be required to forfeit no less than $250 nor more than $1,000 together with all costs of prosecution. Each day or incident of violation shall be deemed a separate offense. In addition to the penalty provided herein, the Town may order the violator to clean up, remove or pay the cost of cleanup and/or removal of any excluded waste, recyclable material, combustible or compost rubbish, garbage, rubbish or construction waste or material disposed of in violation of this article.
