This chapter shall be known as the "Perkiomen Township Park and Open Space Rules and Regulations Ordinance."
This chapter shall regulate the activities of persons in any park and/or open space property owned and maintained by Perkiomen Township.
The Township parks and open space areas shall be open from sunrise to sunset, unless special permission is granted in advance by the Perkiomen Township Board of Supervisors.
A. 
All reservations and permits for the rental of the pavilion located near the Perkiomen Township Administration Building shall be issued by the Township. Such reservations and permits will be issued to Perkiomen Township residents and local service and nonprofit organizations. Otherwise, no discrimination shall be permitted between residents of the immediate area and residents who come from other areas of Perkiomen Township or neighboring municipalities to enjoy the use of Perkiomen Township parks and open spaces;
B. 
Parents and other supervising adults are responsible for the safety and behavior of their children or those children under their supervision;
C. 
Use of Perkiomen Township parks and open space areas shall be in a manner which respects the rights of others using the area;
D. 
No animals are permitted unless attended and controlled, at all times, by a leash. Pet waste shall be immediately cleaned up and disposed of properly by the animal owner (or other responsible party);
E. 
The following activities are prohibited in any Township park or on any open space area unless otherwise authorized and approved by the Perkiomen Township Board of Supervisors:
(1) 
Disorderly or immoral activities or practices;
(2) 
Possession and/or use, sale or consumption of illegal drugs or alcohol;
(3) 
Being in a state of intoxication or under the influence of drugs or alcohol;
(4) 
Throwing of stones, rocks, sticks or any other missile or projectile;
(5) 
Gambling or playing of games for money;
(6) 
Soliciting;
(7) 
Littering;
(8) 
Breaking, defacing or otherwise damaging any bench, table, water fixture, bathroom or any other structure, public property or amenity;
(9) 
Cutting, mutilating or removing any tree, shrub, plant or flower;
(10) 
Possessing or discharging of firearms including air guns and BB guns, paintball guns, slingshots, fireworks, bow and arrows, swords, knives or any other type of weapon or explosive device.
(11) 
Driving or operating of any motor vehicle, including snowmobiles, all-terrain vehicles (ATVs), dirt bikes, go-carts or other similar vehicles;
(12) 
Skateboarding;
(13) 
Posting of any sign, display or banner;
(14) 
Open burning;[2]

(15) 
Trespassing onto adjoining property without permission of the owner;
(16) 
Disturbing the peace by any conduct likely to annoy any other person as defined in the statutes of the Commonwealth of Pennsylvania or the ordinances of Perkiomen Township;
(17) 
Using threatening, abusive, insulting, profane or obscene language or words;
(18) 
Engaging in any activity in a reckless or negligent way or in such a manner as to become a nuisance to other users;
(19) 
Dumping of rubbish or trash of any kind;
(20) 
Repairing, washing, painting or otherwise working on any vehicle.
F. 
Perkiomen Township may prepare a summary of these rules and regulations to be posted at each Perkiomen park and open space area.

Any person or persons, firm, corporation or other legal entity who suspects or knows of a violation of this chapter should file a written citizen's complaint with the Perkiomen Township Code Enforcement Officer. The Township Code Enforcement Officer shall investigate all complaints. If as result of the investigation the Township Code Enforcement Officer determines that a violation of this chapter has occurred, he/she shall issue a written warning to the person(s) responsible for the violation or, in his/her sole discretion, issue a summary nontraffic citation to the person(s) responsible for the violation.
Any person or persons, firm, corporation or other legal entity who shall violate or permit a violation of this chapter, upon being found guilty in a summary proceeding before the Magisterial District Judge having jurisdiction pursuant to the Pennsylvania Rules of Criminal Procedure, shall pay a fine or not more than $1,000 plus court costs for each and every offense and, on default of payment of fine and costs, be liable to imprisonment for not more than 90 days.

In addition to any enforcement or penalty referred to above, any individual, firm, corporation or other legal entity who causes damage to any park or open space area, or to any furniture, utility, receptacle, equipment, fixture, structure or other public property or amenity, shall reimburse Perkiomen Township for the full cost thereof, including the cost of labor to repair and/or replace said damage.
A. 
Individuals or groups will be held responsible for any damage, destruction, defacement or theft of property or facilities which they or their members cause.
B. 
The Township assumes no responsibility for injuries to any person or damage to any property during any individual use or group use of the Township parks or open space areas or any portion, facility, amenity or public property thereof. All Township-owned property is used at the person's own risk.
C. 
The Township shall have no responsibility for any property lost or stolen or left at or on any Township park or open space area.
