A. In addition
to the City's general drug and alcohol testing policy, all City employees
in safety-sensitive positions, as defined in this policy, shall be
subject to random testing for drug and alcohol use. A minimum annual
percentage rate for random testing shall be ten percent (10%) of the
average number of safety-sensitive employees.
B. The selection
of safety-sensitive employees for random testing shall be conducted
by a third (3rd) party in accordance with a scientific valid method
and each safety-sensitive employee shall have an equal chance of being
tested each time selections are made. Random testing shall be unannounced
and the dates for such testing shall be spread reasonably throughout
the calendar year.

Before a safety-sensitive employee returns to duty after engaging
in prohibited conduct regarding alcohol or controlled substance misuse,
the employee will be required to take an alcohol test with a concentration
level under two-hundredths percent (.02%) or a negative result controlled
substance test. Whether the return-to-duty testing is to be solely
for alcohol or controlled substances or both shall be determined on
the prior testing which resulted in a violation of this policy.

Any employee who has violated the alcohol-related or controlled
substance prohibitions in this policy shall, after returning to duty,
be subject to unannounced follow-up alcohol and controlled substance
testing. The number and frequency of the tests shall be determined
by a substance abuse professional and must consist of at least six
(6) tests in the first twelve (12) month period following the employee's
return to duty.

All City employees performing non-clerical duties in the Police
and Fire Departments are safety- sensitive employees. All City employees
who operate heavy equipment or drive City vehicles as part of their
regular job duties are safety-sensitive employees.
