No person shall establish a location for a massage business
unless he/she has a valid massage therapy license issued by the City.
Massage therapists established in existing licensed City businesses
such as salons, health clubs, doctor's offices, etc., need not apply
for a secondary City business license, but will require a permit to
practice.

Every applicant for a license to maintain, operate or conduct
a massage business shall file an application under oath with the City
upon a form provided by the City and shall pay a non-refundable annual
license fee which shall be fifty dollars ($50.00) per year or any
part thereof. As part of the application process, the applying individual
shall grant the City Police Department permission to do a complete
criminal history check.

The Chief of Police shall provide a complete criminal history
check on any individual applying for a City business license for a
massage business within thirty (30) days of application for such and
shall subsequently make a recommendation to the Council based upon
that record.

The City shall issue or deny a license for a massage business
or a permit to practice massage therapy within thirty (30) days after
receiving the application and the recommendation from the Chief of
Police.

No license or permit issued pursuant to this Chapter shall be
transferable.

Every license or permit issued pursuant to this Chapter will
terminate at the expiration of one (1) year from the date of issuance,
unless sooner suspended or revoked.

The licensee shall maintain a register of all persons employed
at any time as massage therapists and their permit number. Such register
shall be available at the location of the establishment to a representative
of the City during regular working hours.

Every licensee under this Article shall display such license
in a prominent place.

A license issued for a massage business may be revoked or suspended
by the City in any case where the licensee has made a false statement
on the application for a license, violated the code of ethics accompanying
the application or where the licensee or an employee of the licensee
has engaged in any conduct which violates any of the State or local
law or ordinances at the licensee's place of business.
